8 | 8 | SECTION 1. Title 2, Water Code, is amended by adding | |

11 | 11 | CHAPTER 39. STANDARDS FOR SURFACE WATER AND GROUNDWATER MANAGEMENT | |
12 | 12 | IN CERTAIN AREAS | |
13 | 13 | Sec. 39.0101. STANDARDS FOR SURFACE WATER AND GROUNDWATER | |
14 | 14 | MANAGEMENT IN CERTAIN AREAS. (a) This section applies to a county: | |
15 | 15 | (1) bordering the Rio Grande; | |
16 | 16 | (2) overlying the Edwards-Trinity Aquifer; and | |
17 | 17 | (3) with a population greater than 40,000. | |
18 | 18 | (b) The Texas Water Development Board shall adopt standards | |
19 | 19 | for water management by a conservation and reclamation district in | |
20 | 20 | a county to which this section applies. | |
21 | 21 | (c) Standards adopted under this section must address: | |
22 | 22 | (1) groundwater management; and | |
23 | 23 | (2) river and spring flow, including flow requirements | |
24 | 24 | for the: | |
25 | 25 | (A) Devils River; | |
26 | 26 | (B) Pecos River; | |
27 | 27 | (C) San Felipe Springs; and | |
28 | 28 | (D) Lake Amistad. | |
29 | 29 | SECTION 2. This Act takes effect September 1, 2021. |
