77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Title 2, Water Code, is amended by adding
99 Subtitle G to read as follows:
1010 SUBTITLE G. MISCELLANEOUS PROVISIONS
1111 CHAPTER 39. STANDARDS FOR SURFACE WATER AND GROUNDWATER MANAGEMENT
1212 IN CERTAIN AREAS
1313 Sec. 39.0101. STANDARDS FOR SURFACE WATER AND GROUNDWATER
1414 MANAGEMENT IN CERTAIN AREAS. (a) This section applies to a county:
1515 (1) bordering the Rio Grande;
1616 (2) overlying the Edwards-Trinity Aquifer; and
1717 (3) with a population greater than 40,000.
1818 (b) The Texas Water Development Board shall adopt standards
1919 for water management by a conservation and reclamation district in
2020 a county to which this section applies.
2121 (c) Standards adopted under this section must address:
2222 (1) groundwater management; and
2323 (2) river and spring flow, including flow requirements
2424 for the:
2525 (A) Devils River;
2626 (B) Pecos River;
2727 (C) San Felipe Springs; and
2828 (D) Lake Amistad.
2929 SECTION 2. This Act takes effect September 1, 2021.
