| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 201, Agriculture Code, is |

| 12 | 12 | | amended by adding Section 201.007 to read as follows: |

| 13 | 13 | | Sec. 201.007. CONFIDENTIALITY OF PARTICIPANTS IN INVASIVE |

| 14 | 14 | | SPECIES ERADICATION PROGRAMS. (a) Except as provided by |
|---|
| 15 | 15 | | Subsection (b), information written, produced, collected, |
|---|
| 16 | 16 | | assembled, or maintained by the state board that would identify a |
|---|
| 17 | 17 | | landowner who participates in a state board program to manage or |
|---|
| 18 | 18 | | eradicate an invasive species is confidential and not subject to |
|---|
| 19 | 19 | | disclosure under Chapter 552, Government Code. |
|---|
| 20 | 20 | | (b) Subsection (a) does not apply to the disclosure of the |
|---|
| 21 | 21 | | identity of a person who receives a direct payment of state money |
|---|
| 22 | 22 | | under a contract with the state board to manage or eradicate an |
|---|
| 23 | 23 | | invasive species. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2021. |
