7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Section 38.001, CIVIL PRACTICE AND REMEDIES | |
9 | 9 | CODE, is amended by amending 38.001 to read as follows: | |
10 | 10 | Sec. 38.001. RECOVERY OF ATTORNEY'S FEES. A person may | |
11 | 11 | recover reasonable attorney's fees from an individual or, | |
12 | 12 | corporation, limited liability company, limited partnership, or | |
13 | 13 | any other type of corporate entity in addition to the amount of a | |
14 | 14 | valid claim and costs, if the claim is for: | |
15 | 15 | (1) rendered services; | |
16 | 16 | (2) performed labor; | |
17 | 17 | (3) furnished material; | |
18 | 18 | (4) freight or express overcharges; | |
19 | 19 | (5) lost or damaged freight or express; | |
20 | 20 | (6) killed or injured stock; | |
21 | 21 | (7) a sworn account; or | |
22 | 22 | (8) an oral or written contract. | |
23 | 23 | SECTION 2. This Act takes effect September 1, 2021. |
