| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 39.001, Education Code, is amended by | |
| 12 | 12 | adding Subsection (c) to read as follows: | |
| 13 | 13 | (c) Notwithstanding any other law, the implementation of a | |
| 14 | 14 | rule adopted by the commissioner or the agency that affects methods | |
| 15 | 15 | or procedures for administering provisions of this chapter may be | |
| 16 | 16 | delayed until the second school year after the school year the rule | |
| 17 | 17 | is adopted unless the commissioner or the agency is required by law | |
| 18 | 18 | to adopt and implement such a rule in a shorter period. | |
| 19 | 19 | SECTION 2. Section 39.001(c), Education Code, as added by | |
| 20 | 20 | this Act, applies only to a rule adopted on or after the effective | |
| 21 | 21 | date of this Act. | |
| 22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
| 23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
| 24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
| 25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
| 26 | 26 | Act takes effect September 1, 2021. |
