9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter D, Chapter 39, Utilities Code, is | |
11 | 11 | amended by adding Section 39.159 to read as follows: | |
12 | 12 | Sec. 39.159. LOAD SHED PERCENTAGE CALCULATIONS. (a) The | |
13 | 13 | commission by rule shall require each transmission and distribution | |
14 | 14 | utility, municipally owned utility, and electric cooperative in the | |
15 | 15 | ERCOT power region to submit annually to the independent | |
16 | 16 | organization certified for the ERCOT power region a determination | |
17 | 17 | of the utility's or cooperative's peak load for the summer season | |
18 | 18 | and peak load for the winter season. | |
19 | 19 | (b) The independent organization certified for the ERCOT | |
20 | 20 | power region shall make annual determinations of load shed | |
21 | 21 | percentages for use during emergency curtailment based on the peak | |
22 | 22 | load information submitted under Subsection (a). | |
23 | 23 | (c) The independent organization certified for the ERCOT | |
24 | 24 | power region may use a look-back period to determine load shed | |
25 | 25 | percentages for use during emergency curtailment if the independent | |
26 | 26 | organization does not have sufficient information submitted under | |
27 | 27 | Subsection (a) for the organization to make the determination as | |
28 | 28 | provided by Subsection (b). | |
29 | 29 | SECTION 2. This Act takes effect September 1, 2021. |
