9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 81.032, Local Government Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Sec. 81.032. ACCEPTANCE OF DONATIONS AND BEQUESTS. (a) | |
13 | 13 | Except as provided by Subsection (b), the [The] commissioners court | |
14 | 14 | may accept a donation of labor or services, gift, grant, donation, | |
15 | 15 | bequest, or devise of money or other property on behalf of the | |
16 | 16 | county, including a donation under Chapter 38, Government Code, for | |
17 | 17 | the purpose of performing a function conferred by law on the county | |
18 | 18 | or a county officer. | |
19 | 19 | (b) The commissioners court may not: | |
20 | 20 | (1) accept a donation of $1,000 or more for the purpose | |
21 | 21 | of administering elections without written consent from the | |
22 | 22 | secretary of state; or | |
23 | 23 | (2) use a donation described by Subsection (a) to | |
24 | 24 | perform a function of administering elections that is not | |
25 | 25 | explicitly authorized by the Election Code. | |
26 | 26 | SECTION 2. This Act takes effect September 1, 2021. |
