55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to rate change proceedings for certain water and sewer
88 utilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 13.18715, Water Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) Notwithstanding Section 13.1871, when the regulatory
1313 authority sets a complaint for hearing under Section 13.1871(i):
1414 (1) the regulatory authority shall suspend the
1515 effective date of the rate change; and
1616 (2) until a final determination is made on the
1717 utility's proposed rate, the utility may not charge or collect a
1818 rate other than the rate the utility charged immediately before the
1919 utility filed the rate change application.
2020 SECTION 2. Section 13.1872, Water Code, is amended by
2121 adding Subsection (g) to read as follows:
2222 (g) Notwithstanding Section 13.1871, when the regulatory
2323 authority sets a complaint for hearing under Section 13.1871(i):
2424 (1) the regulatory authority shall suspend the
2525 effective date of the rate change; and
2626 (2) until a final determination is made on the
2727 utility's proposed rate, the utility may not charge or collect a
2828 rate other than the rate the utility charged immediately before the
2929 utility filed the rate change application.
3030 SECTION 3. The changes in law made by this Act apply only to
3131 a proceeding affecting the rates of a Class C or Class D utility, as
3232 defined by Section 13.002, Water Code, that commences on or after
3333 the effective date of this Act. A proceeding affecting the rates of
3434 a Class C or Class D utility that commenced before the effective
3535 date of this Act is governed by the law in effect on the date the
3636 proceeding is commenced, and that law is continued in effect for
3737 that purpose.
3838 SECTION 4. This Act takes effect September 1, 2021.
