| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 13.18715, Water Code, is amended by |
|---|
| 11 | 11 | | adding Subsection (d) to read as follows: |
|---|
| 12 | 12 | | (d) Notwithstanding Section 13.1871, when the regulatory |
|---|
| 13 | 13 | | authority sets a complaint for hearing under Section 13.1871(i): |
|---|
| 14 | 14 | | (1) the regulatory authority shall suspend the |
|---|
| 15 | 15 | | effective date of the rate change; and |
|---|
| 16 | 16 | | (2) until a final determination is made on the |
|---|
| 17 | 17 | | utility's proposed rate, the utility may not charge or collect a |
|---|
| 18 | 18 | | rate other than the rate the utility charged immediately before the |
|---|
| 19 | 19 | | utility filed the rate change application. |

| 20 | 20 | | SECTION 2. Section 13.1872, Water Code, is amended by |
|---|
| 21 | 21 | | adding Subsection (g) to read as follows: |
|---|
| 22 | 22 | | (g) Notwithstanding Section 13.1871, when the regulatory |
|---|
| 23 | 23 | | authority sets a complaint for hearing under Section 13.1871(i): |

|---|
| 31 | 31 | | a proceeding affecting the rates of a Class C or Class D utility, as |
|---|
| 32 | 32 | | defined by Section 13.002, Water Code, that commences on or after |
|---|
| 33 | 33 | | the effective date of this Act. A proceeding affecting the rates of |
|---|
| 34 | 34 | | a Class C or Class D utility that commenced before the effective |
|---|
| 35 | 35 | | date of this Act is governed by the law in effect on the date the |
|---|
| 36 | 36 | | proceeding is commenced, and that law is continued in effect for |
|---|
| 37 | 37 | | that purpose. |

| 38 | 38 | | SECTION 4. This Act takes effect September 1, 2021. |
