5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to a school psychologist licensed under the Occupations
8	8	Code.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 38.303(a), Education Code, is amended to
11	11	read as follows:
12	12	(a) The task force is composed of:
13	13	(1) the commissioner or the commissioner's designee;
14	14	(2) the following additional members appointed by the
15	15	commissioner:
16	16	(A) three parents of students who are enrolled in
17	17	school districts or open-enrollment charter schools and receive the
18	18	mental health services described by Section 38.302(1);
19	19	(B) one person who provides the mental health
20	20	services described by Section 38.302(1) or the training described
21	21	by Section 38.302(2) and who is:
22	22	(i) a licensed professional counselor, as
23	23	defined by Section 503.002, Occupations Code;
24	24	(ii) a licensed clinical social worker, as
25	25	defined by Section 505.002, Occupations Code; or
26	26	(iii) a school counselor certified under
27	27	Subchapter B, Chapter 21;
28	28	(C) one person who is a psychiatrist;
29	29	(D) two persons who are administrators of
30	30	districts or schools that provide the mental health services
31	31	described by Section 38.302(1) or the training described by Section
32	32	38.302(2);
33	33	(E) one person who is a member of a foundation
34	34	that invests in the mental health services described by Section
35	35	38.302(1) or the training described by Section 38.302(2);
36	36	(F) one person who is an employee of an
37	37	institution of higher education designated under Section 38.307;
38	38	and
39	39	(G) one person who is a [licensed specialist in]
40	40	school psychologist [psychology], as defined by Section 501.002,
41	41	Occupations Code; and
42	42	(3) for any other entity the task force considers
43	43	necessary, one person appointed by the task force for each such
44	44	entity.
45	45	SECTION 2. Section 48.1021(b), Education Code, is amended
46	46	to read as follows:
47	47	(b) The advisory committee consists of the following
48	48	members appointed by the commissioner:
49	49	(1) a parent of a student eligible to participate in a
50	50	school district's special education program under Section 29.003;
51	51	(2) a director of a school district's special
52	52	education program under Subchapter A, Chapter 29;
53	53	(3) a teacher certified in special education;
54	54	(4) a diagnostician;
55	55	(5) a [licensed specialist in] school psychologist, as
56	56	defined by Section 501.002, Occupations Code [psychology];
57	57	(6) a provider who provides related services, as
58	58	described by Section 29.002(2);
59	59	(7) a superintendent of a school district;
60	60	(8) a member of a school district's board of trustees;
61	61	(9) a representative of a disability advocacy
62	62	organization;
63	63	(10) a member of the special education continuing
64	64	advisory committee under Section 29.006;
65	65	(11) a teacher certified in general education;
66	66	(12) a student eligible to participate in a school
67	67	district's special education program under Section 29.003;
68	68	(13) a representative of a regional education service
69	69	center; and
70	70	(14) a school district official who handles business
71	71	and finance matters for the district.
72	72	SECTION 3. Section 531.02171(a), Government Code, is
73	73	amended to read as follows:
74	74	(a) In this section, "health professional" means an
75	75	individual who is:
76	76	(1) licensed, registered, certified, or otherwise
77	77	authorized by this state to practice as a social worker,
78	78	occupational therapist, or speech-language pathologist;
79	79	(2) a licensed professional counselor;
80	80	(3) a licensed marriage and family therapist; or
81	81	(4) a [licensed specialist in] school psychologist, as
82	82	defined by Section 501.002, Occupations Code [psychology].
83	83	SECTION 4. Section 501.002(2), Occupations Code, is amended
84	84	to read as follows:
85	85	(2) "School psychologist" ["Licensed specialist in
86	86	school psychology"] means a person who holds a license to engage in
87	87	the practice of psychology under Section 501.260.
88	88	SECTION 5. Section 501.051(a-1), Occupations Code, is
89	89	amended to read as follows:
90	90	(a-1) One of the members appointed under Subsection (a)(1)
91	91	or (a)(2) must practice as a [licensed specialist in] school
92	92	psychologist [psychology] under Section 501.260.
93	93	SECTION 6. The heading to Section 501.260, Occupations
94	94	Code, is amended to read as follows:
95	95	Sec. 501.260. [LICENSED SPECIALIST IN] SCHOOL PSYCHOLOGIST
96	96	[PSYCHOLOGY].
97	97	SECTION 7. Sections 501.260(a) and (c), Occupations Code,
98	98	are amended to read as follows:
99	99	(a) The executive council by rule shall issue a license to a
100	100	[licensed specialist in] school psychologist [psychology]. A
101	101	license issued under this section constitutes the appropriate
102	102	credential for a person who provides psychological services as
103	103	required by Section 21.003(b), Education Code.
104	104	(c) The rules of practice for a [licensed specialist in]
105	105	school psychologist [psychology] must comply with nationally
106	106	recognized standards for the practice of school psychology.
107	107	SECTION 8. This Act takes effect September 1, 2021.
