55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a school psychologist licensed under the Occupations
88 Code.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.303(a), Education Code, is amended to
1111 read as follows:
1212 (a) The task force is composed of:
1313 (1) the commissioner or the commissioner's designee;
1414 (2) the following additional members appointed by the
1515 commissioner:
1616 (A) three parents of students who are enrolled in
1717 school districts or open-enrollment charter schools and receive the
1818 mental health services described by Section 38.302(1);
1919 (B) one person who provides the mental health
2020 services described by Section 38.302(1) or the training described
2121 by Section 38.302(2) and who is:
2222 (i) a licensed professional counselor, as
2323 defined by Section 503.002, Occupations Code;
2424 (ii) a licensed clinical social worker, as
2525 defined by Section 505.002, Occupations Code; or
2626 (iii) a school counselor certified under
2727 Subchapter B, Chapter 21;
2828 (C) one person who is a psychiatrist;
2929 (D) two persons who are administrators of
3030 districts or schools that provide the mental health services
3131 described by Section 38.302(1) or the training described by Section
3232 38.302(2);
3333 (E) one person who is a member of a foundation
3434 that invests in the mental health services described by Section
3535 38.302(1) or the training described by Section 38.302(2);
3636 (F) one person who is an employee of an
3737 institution of higher education designated under Section 38.307;
3838 and
3939 (G) one person who is a [licensed specialist in]
4040 school psychologist [psychology], as defined by Section 501.002,
4141 Occupations Code; and
4242 (3) for any other entity the task force considers
4343 necessary, one person appointed by the task force for each such
4444 entity.
4545 SECTION 2. Section 48.1021(b), Education Code, is amended
4646 to read as follows:
4747 (b) The advisory committee consists of the following
4848 members appointed by the commissioner:
4949 (1) a parent of a student eligible to participate in a
5050 school district's special education program under Section 29.003;
5151 (2) a director of a school district's special
5252 education program under Subchapter A, Chapter 29;
5353 (3) a teacher certified in special education;
5454 (4) a diagnostician;
5555 (5) a [licensed specialist in] school psychologist, as
5656 defined by Section 501.002, Occupations Code [psychology];
5757 (6) a provider who provides related services, as
5858 described by Section 29.002(2);
5959 (7) a superintendent of a school district;
6060 (8) a member of a school district's board of trustees;
6161 (9) a representative of a disability advocacy
6262 organization;
6363 (10) a member of the special education continuing
6464 advisory committee under Section 29.006;
6565 (11) a teacher certified in general education;
6666 (12) a student eligible to participate in a school
6767 district's special education program under Section 29.003;
6868 (13) a representative of a regional education service
6969 center; and
7070 (14) a school district official who handles business
7171 and finance matters for the district.
7272 SECTION 3. Section 531.02171(a), Government Code, is
7373 amended to read as follows:
7474 (a) In this section, "health professional" means an
7575 individual who is:
7676 (1) licensed, registered, certified, or otherwise
7777 authorized by this state to practice as a social worker,
7878 occupational therapist, or speech-language pathologist;
7979 (2) a licensed professional counselor;
8080 (3) a licensed marriage and family therapist; or
8181 (4) a [licensed specialist in] school psychologist, as
8282 defined by Section 501.002, Occupations Code [psychology].
8383 SECTION 4. Section 501.002(2), Occupations Code, is amended
8484 to read as follows:
8585 (2) "School psychologist" ["Licensed specialist in
8686 school psychology"] means a person who holds a license to engage in
8787 the practice of psychology under Section 501.260.
8888 SECTION 5. Section 501.051(a-1), Occupations Code, is
8989 amended to read as follows:
9090 (a-1) One of the members appointed under Subsection (a)(1)
9191 or (a)(2) must practice as a [licensed specialist in] school
9292 psychologist [psychology] under Section 501.260.
9393 SECTION 6. The heading to Section 501.260, Occupations
9494 Code, is amended to read as follows:
9595 Sec. 501.260. [LICENSED SPECIALIST IN] SCHOOL PSYCHOLOGIST
9696 [PSYCHOLOGY].
9797 SECTION 7. Sections 501.260(a) and (c), Occupations Code,
9898 are amended to read as follows:
9999 (a) The executive council by rule shall issue a license to a
100100 [licensed specialist in] school psychologist [psychology]. A
101101 license issued under this section constitutes the appropriate
102102 credential for a person who provides psychological services as
103103 required by Section 21.003(b), Education Code.
104104 (c) The rules of practice for a [licensed specialist in]
105105 school psychologist [psychology] must comply with nationally
106106 recognized standards for the practice of school psychology.
107107 SECTION 8. This Act takes effect September 1, 2021.
