9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 32.064, Human Resources Code, is amended | |
11 | 11 | by adding Subsection (e) to read as follows: | |
12 | 12 | (e) Notwithstanding any provision of this section, Section | |
13 | 13 | 32.0641, or other law, the executive commissioner may not adopt | |
14 | 14 | rules imposing on a recipient of medical assistance a copayment or | |
15 | 15 | other cost-sharing requirement for the receipt of physical therapy | |
16 | 16 | services in an amount that is greater than a copayment or other | |
17 | 17 | cost-sharing requirement imposed on the recipient for the receipt | |
18 | 18 | of a primary care service. | |
19 | 19 | SECTION 2. If before implementing any provision of this Act | |
20 | 20 | a state agency determines that a waiver or authorization from a | |
21 | 21 | federal agency is necessary for implementation of that provision, | |
22 | 22 | the agency affected by the provision shall request the waiver or | |
23 | 23 | authorization and may delay implementing that provision until the | |
24 | 24 | waiver or authorization is granted. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
