55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the exemption of certain vehicles from vehicle towing
88 regulations.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2308.002(11), Occupations Code, is
1111 amended to read as follows:
1212 (11) "Tow truck" means a motor vehicle, including a
1313 wrecker, equipped with a mechanical device used to tow, winch, or
1414 otherwise move another motor vehicle. The term does not include:
1515 (A) a motor vehicle owned and operated by a
1616 governmental entity, including a public school district;
1717 (B) a motor vehicle towing:
1818 (i) a race car;
1919 (ii) a motor vehicle for exhibition; or
2020 (iii) an antique motor vehicle;
2121 (C) a recreational vehicle towing another
2222 vehicle;
2323 (D) a motor vehicle used in combination with a
2424 tow bar, tow dolly, or other mechanical device if the vehicle is not
2525 operated in the furtherance of a commercial enterprise;
2626 (E) a motor vehicle that is controlled or
2727 operated by a farmer or rancher and used for towing a farm vehicle;
2828 (F) a motor vehicle that:
2929 (i) is owned or operated by an entity the
3030 primary business of which is the rental of motor vehicles; and
3131 (ii) only tows vehicles rented by the
3232 entity;
3333 (G) a truck-trailer combination that is owned or
3434 operated by a dealer licensed under Chapter 2301 and used to
3535 transport new vehicles during the normal course of a documented
3636 transaction in which the dealer is a party and ownership or the
3737 right of possession of the transported vehicle is conveyed or
3838 transferred; or
3939 (H) a car hauler that is used solely to
4040 transport, other than in a consent or nonconsent tow, motor
4141 vehicles as cargo:
4242 (i) in the course of a prearranged shipping
4343 transaction;
4444 (ii) in the course of a commercial
4545 transaction for transport arranged or authorized by one business
4646 for the shipping or delivery of a damaged vehicle to another
4747 business; or
4848 (iii) for use in mining, drilling, or
4949 construction operations.
5050 SECTION 2. This Act takes effect September 1, 2021.
