6 | 6 | | relating to the closing of beaches for space flight activities in |

7 | 7 | | certain counties. |

8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Sections 61.132(d) and (f), Natural Resources |
---|
10 | 10 | | Code, are amended to read as follows: |
---|
11 | 11 | | (d) The commissioners court may not close a beach or access |
---|
12 | 12 | | points to the beach: |
---|
13 | 13 | | (1) for a period of more than three calendar days; or |
---|
14 | 14 | | (2) on a primary launch date consisting of any of the |
---|
15 | 15 | | following days without the approval of the land office: |
---|
16 | 16 | | (A) [(1)] the Saturday or Sunday preceding |
---|
17 | 17 | | Memorial Day; |
---|
18 | 18 | | (B) [(2)] Memorial Day; |
---|
19 | 19 | | (C) [(3)] July 4; |
---|
20 | 20 | | (D) [(4)] Labor Day; or |
---|
21 | 21 | | (E) [(5)] a Saturday or Sunday that is after |
---|
22 | 22 | | Memorial Day but before Labor Day. |
---|
23 | 23 | | (f) The land office may: |
---|
24 | 24 | | (1) approve or deny a beach or access point closure |
---|
25 | 25 | | request under Subsection (d)(2) [(d)]; |
---|
26 | 26 | | (2) enter into a memorandum of agreement with the |
---|
27 | 27 | | commissioners court of a county to which this section applies to |
---|
28 | 28 | | govern beach and access point closures made under this section; and |
---|
29 | 29 | | (3) adopt rules to govern beach and access point |
---|
30 | 30 | | closures made under this section. |
---|
31 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
---|
32 | 32 | | a vote of two-thirds of all the members elected to each house, as |
---|
33 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
34 | 34 | | Act does not receive the vote necessary for immediate effect, this |
---|
35 | 35 | | Act takes effect September 1, 2021. |
