44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the closing of beaches for space flight activities in
77 certain counties.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 61.132(d) and (f), Natural Resources
1010 Code, are amended to read as follows:
1111 (d) The commissioners court may not close a beach or access
1212 points to the beach:
1313 (1) for a period of more than three calendar days; or
1414 (2) on a primary launch date consisting of any of the
1515 following days without the approval of the land office:
1616 (A) [(1)] the Saturday or Sunday preceding
1717 Memorial Day;
1818 (B) [(2)] Memorial Day;
1919 (C) [(3)] July 4;
2020 (D) [(4)] Labor Day; or
2121 (E) [(5)] a Saturday or Sunday that is after
2222 Memorial Day but before Labor Day.
2323 (f) The land office may:
2424 (1) approve or deny a beach or access point closure
2525 request under Subsection (d)(2) [(d)];
2626 (2) enter into a memorandum of agreement with the
2727 commissioners court of a county to which this section applies to
2828 govern beach and access point closures made under this section; and
2929 (3) adopt rules to govern beach and access point
3030 closures made under this section.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2021.
