66 AN ACT
77 relating to a prohibition on certain employer requirements relating
88 to employee jury duty compensation.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 61, Labor Code, is amended
1111 by adding Section 61.0185 to read as follows:
1212 Sec. 61.0185. PROHIBITED EMPLOYER REQUIREMENTS RELATING TO
1313 JURY DUTY COMPENSATION. An employer who pays wages, including on a
1414 salary basis, to an employee for any period during which the
1515 employee is absent from work due to reporting for jury service and
1616 discharging that duty may not:
1717 (1) require the employee to remit to the employer any
1818 reimbursement for travel or other expenses, or any other
1919 compensation, received by the employee for that service; or
2020 (2) withhold or divert any part of the employee's wages
2121 to offset the amount of any reimbursement or other compensation
2222 described by Subdivision (1).
2323 SECTION 2. The change in law made by this Act applies only
2424 with respect to reimbursement or compensation for jury service that
2525 commences on or after the effective date of this Act.
2626 SECTION 3. This Act takes effect September 1, 2021.
