9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter B, Chapter 61, Labor Code, is amended | |
11 | 11 | by adding Section 61.0185 to read as follows: | |
12 | 12 | Sec. 61.0185. PROHIBITED EMPLOYER REQUIREMENTS RELATING TO | |
13 | 13 | JURY DUTY COMPENSATION. An employer who pays wages, including on a | |
14 | 14 | salary basis, to an employee for any period during which the | |
15 | 15 | employee is absent from work due to reporting for jury service and | |
16 | 16 | discharging that duty may not: | |
17 | 17 | (1) require the employee to remit to the employer any | |
18 | 18 | reimbursement for travel or other expenses, or any other | |
19 | 19 | compensation, received by the employee for that service; or | |
20 | 20 | (2) withhold or divert any part of the employee's wages | |
21 | 21 | to offset the amount of any reimbursement or other compensation | |
22 | 22 | described by Subdivision (1). | |
23 | 23 | SECTION 2. The change in law made by this Act applies only | |
24 | 24 | with respect to reimbursement or compensation for jury service that | |
25 | 25 | commences on or after the effective date of this Act. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2021. |
