55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to remedial plans issued by the State Board of Dental
88 Examiners to address complaints against dentists and dental
99 hygienists.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 263.0077, Occupations Code, is amended
1212 by amending Subsection (d) and adding Subsection (f-1) to read as
1313 follows:
1414 (d) The board may not issue a remedial plan to resolve a
1515 complaint against a license holder if the license holder has
1616 entered into a remedial plan with the board in the preceding five
1717 years [previously entered into a remedial plan with the board for
1818 the resolution of a different complaint filed under this subtitle].
1919 (f-1) On or after the fifth anniversary of the date a
2020 remedial plan is issued under this section, the board may remove
2121 from the board's public Internet website any public information
2222 regarding the dentist or dental hygienist with respect to the plan
2323 and the complaint resolved by the plan, unless:
2424 (1) the complaint was related to the delivery of
2525 health care; or
2626 (2) more than one remedial plan has been issued to
2727 resolve complaints alleging the same violation by the dentist or
2828 dental hygienist, including a complaint not related to the delivery
2929 of health care.
3030 SECTION 2. Section 263.0077, Occupations Code, as amended
3131 by this Act, applies to a remedial plan issued by the State Board of
3232 Dental Examiners on or after the effective date of this Act. A
3333 remedial plan issued before that date is governed by the law in
3434 effect on the date the plan was issued, and the former law is
3535 continued in effect for that purpose.
3636 SECTION 3. This Act takes effect September 1, 2021.
