| 8 | 8 | | Examiners to address complaints against dentists and dental |
|---|
| 9 | 9 | | hygienists. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 11 | 11 | | SECTION 1. Section 263.0077, Occupations Code, is amended |
|---|
| 12 | 12 | | by amending Subsection (d) and adding Subsection (f-1) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (d) The board may not issue a remedial plan to resolve a |
|---|
| 15 | 15 | | complaint against a license holder if the license holder has |
|---|
| 16 | 16 | | entered into a remedial plan with the board in the preceding five |
|---|
| 17 | 17 | | years [previously entered into a remedial plan with the board for |
|---|
| 18 | 18 | | the resolution of a different complaint filed under this subtitle]. |
|---|
| 19 | 19 | | (f-1) On or after the fifth anniversary of the date a |
|---|
| 20 | 20 | | remedial plan is issued under this section, the board may remove |
|---|
| 21 | 21 | | from the board's public Internet website any public information |
|---|
| 22 | 22 | | regarding the dentist or dental hygienist with respect to the plan |
|---|
| 23 | 23 | | and the complaint resolved by the plan, unless: |
|---|
| 24 | 24 | | (1) the complaint was related to the delivery of |
|---|
| 25 | 25 | | health care; or |
|---|
| 26 | 26 | | (2) more than one remedial plan has been issued to |
|---|
| 27 | 27 | | resolve complaints alleging the same violation by the dentist or |
|---|
| 28 | 28 | | dental hygienist, including a complaint not related to the delivery |
|---|
| 29 | 29 | | of health care. |
|---|
| 30 | 30 | | SECTION 2. Section 263.0077, Occupations Code, as amended |
|---|
| 31 | 31 | | by this Act, applies to a remedial plan issued by the State Board of |
|---|
| 32 | 32 | | Dental Examiners on or after the effective date of this Act. A |
|---|
| 33 | 33 | | remedial plan issued before that date is governed by the law in |
|---|
| 34 | 34 | | effect on the date the plan was issued, and the former law is |
|---|
| 35 | 35 | | continued in effect for that purpose. |
|---|
| 36 | 36 | | SECTION 3. This Act takes effect September 1, 2021. |
