44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to donations to local charities ordered to be paid as a
77 condition of community supervision.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 42A.304(f), Code of Criminal Procedure,
1010 is amended to read as follows:
1111 (f) Instead of requiring the defendant to work a specified
1212 number of hours at one or more community service projects under
1313 Subsection (a), the judge may order a defendant to make a specified
1414 donation to:
1515 (1) a nonprofit food bank or food pantry in the
1616 community in which the defendant resides;
1717 (2) a charitable organization engaged primarily in
1818 performing charitable functions for veterans in the community in
1919 which the defendant resides; or
2020 (3) a veterans county service office established by
2121 the commissioners court as provided by Government Code, Subchapter
2222 B, Chapter 434; or
2323 (4) in a county with a population of less than 50,000,
2424 another nonprofit organization that:
2525 (A) is exempt from taxation under Section 501(a)
2626 of the Internal Revenue Code of 1986 because it is listed in Section
2727 501(c)(3) of that code; and
2828 (B) provides services or assistance to needy
2929 individuals and families in the community in which the defendant
3030 resides.
3131 SECTION 2. This Act takes effect September 1, 2021.
