66 AN ACT
77 relating to a border operations training program for peace officers
88 employed by local law enforcement agencies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 411, Government Code, is
1111 amended by adding Section 411.02096 to read as follows:
1212 Sec. 411.02096. BORDER OPERATIONS TRAINING PROGRAM. (a)
1313 The department, in coordination with local law enforcement
1414 agencies, shall establish and administer a border operations
1515 training program for peace officers employed by local law
1616 enforcement agencies that will prepare the officers to:
1717 (1) collaborate and cooperate with and assist any law
1818 enforcement agency in the interdiction, investigation, and
1919 prosecution of criminal activity in the Texas-Mexico border region;
2020 and
2121 (2) collaborate and cooperate with and assist district
2222 attorneys, county attorneys, the border prosecution unit, and other
2323 prosecutors in the investigation and prosecution of allegations of
2424 criminal activity in the Texas-Mexico border region.
2525 (b) The training program under Subsection (a) must include:
2626 (1) information on:
2727 (A) criminal activity occurring along the
2828 Texas-Mexico border, including drug trafficking and trafficking of
2929 persons and other activity carried out by cartels, transnational
3030 gangs, and other groups engaged in organized criminal activity; and
3131 (B) methods for identifying northbound,
3232 southbound, and intrastate criminal activity associated with drug
3333 trafficking, trafficking of persons, and other organized criminal
3434 activity;
3535 (2) best practices for investigating and prosecuting
3636 the criminal activity described by Subdivision (1) and securing the
3737 Texas-Mexico border; and
3838 (3) an overview of the department's operations at the
3939 Texas-Mexico border, including any collaboration with the United
4040 States Customs and Border Protection.
4141 (c) The department shall identify opportunities for a peace
4242 officer described by Subsection (a) to assist in the department's
4343 duties related to border operations. The department may authorize
4444 the officer to assist in carrying out those duties.
4545 (d) A peace officer authorized by the department to assist
4646 in carrying out duties related to the department's border
4747 operations as described by Subsection (c) is not entitled to
4848 compensation from the department for the assistance provided.
4949 (e) The department may partner with federal agencies in
5050 administering the training program under Subsection (a) and
5151 facilitating any assistance provided by a peace officer under
5252 Subsection (c).
5353 SECTION 2. Subchapter H, Chapter 1701, Occupations Code, is
5454 amended by adding Section 1701.359 to read as follows:
5555 Sec. 1701.359. BORDER OPERATIONS TRAINING PROGRAM. The
5656 commission may:
5757 (1) recognize, or with the consent of the Department
5858 of Public Safety administer or assist in administering, the border
5959 operations training program established under Section 411.02096,
6060 Government Code, as a continuing education program for officers;
6161 and
6262 (2) credit an officer who successfully completes the
6363 program described by Subdivision (1) with the appropriate number of
6464 continuing education hours.
6565 SECTION 3. This Act takes effect September 1, 2021.
