9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter B, Chapter 418, Government Code, is | |
11 | 11 | amended by adding Section 418.027 to read as follows: | |
12 | 12 | Sec. 418.027. PENALTY FOR VIOLATION OF ORDER, PROCLAMATION, | |
13 | 13 | OR REGULATION. Notwithstanding any other law, including Section | |
14 | 14 | 418.173(b), the punishment prescribed for violating an executive | |
15 | 15 | order, proclamation, or regulation issued by the governor under | |
16 | 16 | this chapter may not include a term of confinement. | |
17 | 17 | SECTION 2. The change in law made by this Act applies only | |
18 | 18 | to an offense committed on or after the effective date of this Act. | |
19 | 19 | An offense committed before the effective date of this Act is | |
20 | 20 | governed by the law in effect on the date the offense was committed, | |
21 | 21 | and the former law is continued in effect for that purpose. For | |
22 | 22 | purposes of this section, an offense was committed before the | |
23 | 23 | effective date of this Act if any element of the offense occurred | |
24 | 24 | before that date. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2021. |
