55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the penalty for violating certain executive orders,
88 proclamations, or regulations issued by the governor.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 418, Government Code, is
1111 amended by adding Section 418.027 to read as follows:
1212 Sec. 418.027. PENALTY FOR VIOLATION OF ORDER, PROCLAMATION,
1313 OR REGULATION. Notwithstanding any other law, including Section
1414 418.173(b), the punishment prescribed for violating an executive
1515 order, proclamation, or regulation issued by the governor under
1616 this chapter may not include a term of confinement.
1717 SECTION 2. The change in law made by this Act applies only
1818 to an offense committed on or after the effective date of this Act.
1919 An offense committed before the effective date of this Act is
2020 governed by the law in effect on the date the offense was committed,
2121 and the former law is continued in effect for that purpose. For
2222 purposes of this section, an offense was committed before the
2323 effective date of this Act if any element of the offense occurred
2424 before that date.
2525 SECTION 3. This Act takes effect September 1, 2021.
