| 7 | 7 | | State Board of Plumbing Examiners. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1301.255, Occupations Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | Sec. 1301.255. ADOPTION OF PLUMBING [CODES] CODE. (a) The |
|---|
| 12 | 12 | | board shall adopt [the following plumbing codes, as those codes |
|---|
| 13 | 13 | | existed on May 31, 2001: |
|---|
| 14 | 14 | | [(1) the Uniform Plumbing Code, as published by the |
|---|
| 15 | 15 | | International Association of Plumbing and Mechanical Officials; |
|---|
| 16 | 16 | | and |
|---|
| 17 | 17 | | [(2)] the 2015 edition of the International Plumbing |
|---|
| 18 | 18 | | Code, as published by the International Code Council. |
|---|
| 19 | 19 | | (b) The board by rule may adopt a later edition [editions] |
|---|
| 20 | 20 | | of the plumbing code [codes] listed in Subsection (a). |
|---|
| 21 | 21 | | (c) Plumbing installed in an area not otherwise subject to |
|---|
| 22 | 22 | | regulation under this chapter by a person licensed under this |
|---|
| 23 | 23 | | chapter must be installed in accordance with the plumbing code |
|---|
| 24 | 24 | | adopted by the board under Subsection (a). |
|---|
| 25 | 25 | | (d) In adopting a code for the design, installation, and |
|---|
| 26 | 26 | | maintenance of a plumbing system under this section, a municipality |
|---|
| 27 | 27 | | or an owner of a public water system may amend any provisions of the |
|---|
| 28 | 28 | | code to conform to local concerns that do not substantially vary |
|---|
| 29 | 29 | | from board rules or other rules of this state. |
|---|
| 30 | 30 | | (e) Plumbing installed in compliance with the code adopted |
|---|
| 31 | 31 | | under Subsection (a), (b), or (d) must be inspected by a plumbing |
|---|
| 32 | 32 | | inspector. To perform the inspection, the political subdivision |
|---|
| 33 | 33 | | may contract with any plumbing inspector or qualified plumbing |
|---|
| 34 | 34 | | inspection business, as determined by the political subdivision, |
|---|
| 35 | 35 | | that is paid directly by the political subdivision. |
|---|
| 36 | 36 | | SECTION 2. Not later than December 1, 2021, the Texas State |
|---|
| 37 | 37 | | Board of Plumbing Examiners shall adopt rules to implement Section |
|---|
| 38 | 38 | | 1301.255, Occupations Code, as amended by this Act. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect September 1, 2021. |
