66 AN ACT
77 relating to continuing education and training requirements for
88 educators and other school district personnel.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 7.058, Education Code, is amended to
1111 read as follows:
1212 Sec. 7.058. RESEARCH ON MATHEMATICS SKILLS ACQUISITION AND
1313 PROGRAM EFFECTIVENESS. From funds appropriated for the purpose,
1414 the commissioner shall award to one or more institutions that have
1515 demonstrated an ability to conduct science-based research on
1616 effective instructional strategies that improve student
1717 performance in mathematics a grant to be used to:
1818 (1) develop and identify research on mathematics
1919 skills acquisition and student learning in mathematics;
2020 (2) monitor the effectiveness of mathematics
2121 achievement academies [professional development institutes] under
2222 Section 21.4553 [21.455] based on performance in mathematics by the
2323 students of teachers who have attended an academy [institute];
2424 (3) examine the effect of mathematics achievement
2525 academies [professional development institutes] on the classroom
2626 performance of teachers who have attended an academy [institute];
2727 (4) identify common practices used at high-performing
2828 school campuses that lead to improved student performance in
2929 mathematics; and
3030 (5) develop research on cognitive development in
3131 children concerning mathematics skills development.
3232 SECTION 2. Section 11.175, Education Code, is amended by
3333 adding Subsection (g) to read as follows:
3434 (g) Notwithstanding Section 2054.5191, Government Code,
3535 only the district's cybersecurity coordinator is required to
3636 complete the cybersecurity training under that section on an annual
3737 basis. Any other school district employee required to complete the
3838 cybersecurity training shall complete the training as determined by
3939 the district, in consultation with the district's cybersecurity
4040 coordinator.
4141 SECTION 3. Sections 21.054(d), (e), and (f), Education
4242 Code, are amended to read as follows:
4343 (d) Continuing education requirements for a classroom
4444 teacher must provide that not more than [at least] 25 percent of the
4545 training required every five years include instruction regarding:
4646 (1) collecting and analyzing information that will
4747 improve effectiveness in the classroom;
4848 (2) recognizing early warning indicators that a
4949 student may be at risk of dropping out of school;
5050 (3) digital learning, digital teaching, and
5151 integrating technology into classroom instruction;
5252 (4) educating diverse student populations, including:
5353 (A) [students who are eligible to participate in
5454 special education programs under Subchapter A, Chapter 29;
5555 [(B) students who are eligible to receive
5656 educational services required under Section 504, Rehabilitation
5757 Act of 1973 (29 U.S.C. Section 794);
5858 [(C)] students with mental health conditions or
5959 who engage in substance abuse;
6060 (B) [(D)] students with intellectual or
6161 developmental disabilities;
6262 (C) [(E)] students who are educationally
6363 disadvantaged; and
6464 (D) [(F) students of limited English
6565 proficiency; and
6666 [(G)] students at risk of dropping out of school;
6767 and
6868 (5) understanding appropriate relationships,
6969 boundaries, and communications between educators and students[;
7070 and
7171 [(6) how mental health conditions, including grief and
7272 trauma, affect student learning and behavior and how
7373 evidence-based, grief-informed, and trauma-informed strategies
7474 support the academic success of students affected by grief and
7575 trauma].
7676 (e) Continuing education requirements for a principal must
7777 provide that not more than [at least] 25 percent of the training
7878 required every five years include instruction regarding:
7979 (1) effective and efficient management, including:
8080 (A) collecting and analyzing information;
8181 (B) making decisions and managing time; and
8282 (C) supervising student discipline and managing
8383 behavior;
8484 (2) recognizing early warning indicators that a
8585 student may be at risk of dropping out of school;
8686 (3) digital learning, digital teaching, and
8787 integrating technology into campus curriculum and instruction;
8888 (4) effective implementation of a comprehensive
8989 school counseling program under Section 33.005;
9090 (5) mental health programs addressing a mental health
9191 condition;
9292 (6) educating diverse student populations, including:
9393 (A) [students who are eligible to participate in
9494 special education programs under Subchapter A, Chapter 29;
9595 [(B)] students with intellectual or
9696 developmental disabilities;
9797 [(C) students who are eligible to receive
9898 educational services required under Section 504, Rehabilitation
9999 Act of 1973 (29 U.S.C. Section 794);]
100100 (B) [(D)] students with mental health conditions
101101 or who engage in substance abuse;
102102 (C) [(E)] students who are educationally
103103 disadvantaged;
104104 (D) [(F)] students of limited English
105105 proficiency; and
106106 (E) [(G)] students at risk of dropping out of
107107 school; and
108108 (7) preventing, recognizing, and reporting any sexual
109109 conduct between an educator and student that is prohibited under
110110 Section 21.12, Penal Code, or for which reporting is required under
111111 Section 21.006 of this code[; and
112112 [(8) how mental health conditions, including grief and
113113 trauma, affect student learning and behavior and how
114114 evidence-based, grief-informed, and trauma-informed strategies
115115 support the academic success of students affected by grief and
116116 trauma].
117117 (f) Continuing education requirements for a counselor must
118118 provide that not more than [at least] 25 percent of training
119119 required every five years include instruction regarding:
120120 (1) assisting students in developing high school
121121 graduation plans;
122122 (2) implementing dropout prevention strategies; and
123123 (3) [informing students concerning:
124124 [(A) college admissions, including college
125125 financial aid resources and application procedures; and
126126 [(B) career opportunities;
127127 [(4) counseling students concerning mental health
128128 conditions and substance abuse, including through the use of
129129 grief-informed and trauma-informed interventions and crisis
130130 management and suicide prevention strategies; and
131131 [(5)] effective implementation of a comprehensive
132132 school counseling program under Section 33.005.
133133 SECTION 4. Sections 21.451(d), (d-1), and (d-3), Education
134134 Code, are amended to read as follows:
135135 (d) The staff development:
136136 (1) may include training in:
137137 (A) technology and digital learning; and
138138 (B) positive behavior intervention and support
139139 strategies, including classroom management, district discipline
140140 policies, and the student code of conduct adopted under Chapter 37;
141141 [and
142142 [(C) digital learning;]
143143 (2) subject to Subsection (e) and to Section 21.3541
144144 and rules adopted under that section, must include training that is
145145 evidence-based, as defined by Section 8101, Every Student Succeeds
146146 Act (20 U.S.C. Section 7801), and that:
147147 (A) relates to instruction of students with
148148 disabilities, including students with disabilities who also have
149149 other intellectual or mental health conditions; and
150150 (B) is designed for educators who work primarily
151151 outside the area of special education; and
152152 (3) must include training on:
153153 (A) suicide prevention;
154154 (B) [recognizing signs of mental health
155155 conditions and substance abuse;
156156 [(C)] strategies for establishing and
157157 maintaining positive relationships among students, including
158158 conflict resolution;
159159 [(D) how grief and trauma affect student learning
160160 and behavior and how evidence-based, grief-informed, and
161161 trauma-informed strategies support the academic success of
162162 students affected by grief and trauma;] and
163163 (C) [(E)] preventing, identifying, responding
164164 to, and reporting incidents of bullying.
165165 (d-1) The training required by Subsection (d)(3):
166166 (1) must:
167167 (A) be provided in accordance with the frequency
168168 requirement adopted for the training under Section 21.4515; [:
169169 [(i) on an annual basis, as part of a new
170170 employee orientation, to all new school district and
171171 open-enrollment charter school educators; and
172172 [(ii) to existing school district and
173173 open-enrollment charter school educators on a schedule adopted by
174174 the agency by rule;] and
175175 (B) use a best practice-based program
176176 recommended by the Health and Human Services Commission in
177177 coordination with the agency under Section 38.351; and
178178 (2) may include two or more listed topics together.
179179 (d-3) The technology and digital learning training provided
180180 by Subsection (d)(1)(A) [(d)(1)(E)] must:
181181 (1) discuss basic technology proficiency expectations
182182 and methods to increase an educator's digital literacy; and
183183 (2) assist an educator in the use of digital
184184 technology in learning activities that improve teaching,
185185 assessment, and instructional practices.
186186 SECTION 5. Subchapter J, Chapter 21, Education Code, is
187187 amended by adding Sections 21.4514 and 21.4515 to read as follows:
188188 Sec. 21.4514. CONTINUING EDUCATION AND TRAINING
189189 CLEARINGHOUSE. (a) The State Board for Educator Certification
190190 shall develop and publish a comprehensive clearinghouse of
191191 information regarding continuing education and training
192192 requirements of:
193193 (1) educators; and
194194 (2) other school personnel.
195195 (b) The clearinghouse must include the recommendations of
196196 the State Board for Educator Certification regarding the frequency
197197 for the completion of each continuing education or training by
198198 educators or other school personnel based on best practices and
199199 industry recommendations for the provision of that continuing
200200 education or training.
201201 Sec. 21.4515. FREQUENCY REQUIREMENTS FOR COMPLETION OF
202202 TRAININGS. (a) The board of trustees of a school district and the
203203 governing body of an open-enrollment charter school, to the extent
204204 applicable, shall annually review the clearinghouse developed
205205 under Section 21.4514 and adopt frequency requirements for the
206206 completion of each required continuing education or training for
207207 which a frequency is not provided by statute. In adopting the
208208 frequency requirements, the board of trustees or the governing body
209209 must consider the recommendations provided in the clearinghouse but
210210 may adjust the required frequency for the completion of each
211211 continuing education or training to best meet the needs of the
212212 district or school.
213213 (b) To the extent of any conflict, a frequency requirement
214214 for the completion of continuing education or training adopted by
215215 the board of trustees of a school district or the governing body of
216216 an open-enrollment charter school under Subsection (a) prevails
217217 over a state agency rule regarding a required frequency for the
218218 completion of continuing education or training for which a required
219219 frequency is not provided by statute, including a rule requiring
220220 training on exposure to bloodborne pathogens.
221221 SECTION 6. Section 21.4552, Education Code, is amended by
222222 amending Subsections (a), (b), and (c) and adding Subsection (b-1)
223223 to read as follows:
224224 (a) The commissioner shall develop and make available
225225 literacy achievement academies for teachers who provide reading
226226 instruction to students at any grade level [at the kindergarten or
227227 first, second, or third grade level].
228228 (b) A literacy achievement academy developed under this
229229 section:
230230 (1) for teachers who provide reading instruction to
231231 students at the kindergarten or first, second, or third grade
232232 level:
233233 (A) [(1)] must include training in:
234234 (i) [(A)] effective and systematic
235235 instructional practices in reading, including phonemic awareness,
236236 phonics, fluency, vocabulary, and comprehension; and
237237 (ii) [(B)] the use of empirically validated
238238 instructional methods that are appropriate for struggling readers;
239239 and
240240 (B) [(2)] may include training in effective
241241 instructional practices in writing;
242242 (2) for teachers who provide reading instruction to
243243 students at the fourth or fifth grade level:
244244 (A) must include effective instructional
245245 practices that promote student development of reading
246246 comprehension and inferential and critical thinking;
247247 (B) must provide training in the use of
248248 empirically validated instructional methods that are appropriate
249249 for struggling readers; and
250250 (C) may include material on writing instruction;
251251 (3) for teachers who provide reading instruction to
252252 students at the seventh or eighth grade level, must include
253253 training in:
254254 (A) administration of the reading instrument
255255 required by Section 28.006(c-1); and
256256 (B) interpretation of the results of the reading
257257 instrument required by Section 28.006(c-1) and strategies, based on
258258 scientific research regarding effective reading instruction, for
259259 long-term intensive intervention to target identified student
260260 needs in word recognition, vocabulary, fluency, and comprehension;
261261 (4) for teachers who provide reading instruction to
262262 students at the sixth, seventh, or eighth grade level, must include
263263 training in:
264264 (A) strategies to be implemented in English
265265 language arts and other subject areas for multisyllable word
266266 reading, vocabulary development, and comprehension of expository
267267 and narrative text;
268268 (B) an adaptation framework that enables
269269 teachers to respond to differing student strengths and needs,
270270 including adaptations for students of limited English proficiency
271271 or students receiving special education services under Subchapter
272272 A, Chapter 29;
273273 (C) collaborative strategies to increase active
274274 student involvement and motivation to read; and
275275 (D) other areas identified by the commissioner as
276276 essential components of reading instruction; and
277277 (5) for teachers who provide instruction in
278278 mathematics, science, or social studies to students at the sixth,
279279 seventh, or eighth grade level, must include training in:
280280 (A) strategies for incorporating reading
281281 instruction into the curriculum for the subject area taught by the
282282 teacher; and
283283 (B) other areas identified by the commissioner.
284284 (b-1) The completion of a literacy achievement academy
285285 under this section by an educator who teaches students with
286286 dyslexia satisfies the training requirement under Section
287287 21.054(b).
288288 (c) The commissioner shall adopt criteria for selecting
289289 teachers who may attend a literacy achievement academy. In adopting
290290 selection criteria under this subsection, the commissioner shall:
291291 (1) require a teacher to attend a literacy achievement
292292 academy if the teacher provides instruction in reading,
293293 mathematics, science, or social studies to students at the sixth,
294294 seventh, or eighth grade level at a campus that fails to satisfy any
295295 standard under Section 39.054(e) on the basis of student
296296 performance on the reading assessment instrument administered
297297 under Section 39.023(a) to students in any grade level at the
298298 campus;
299299 (2) grant [granting a] priority to teachers employed
300300 by a school district at a campus at which 50 percent or more of the
301301 students enrolled are educationally disadvantaged; and
302302 (3) [(2)] provide a process through which a teacher
303303 not employed at a campus described by Subdivision (2) [(1)] may
304304 attend the academy if the academy has available space and the school
305305 district employing the teacher pays the costs of the teacher's
306306 attendance.
307307 SECTION 7. Sections 21.4553(a) and (b), Education Code, are
308308 amended to read as follows:
309309 (a) The commissioner shall develop and make available
310310 mathematics achievement academies for teachers who provide
311311 mathematics instruction to students at any grade level [the
312312 kindergarten or first, second, or third grade level].
313313 (b) A mathematics achievement academy developed under this
314314 section must, if appropriate for the grade level at which the
315315 teacher provides instruction, include training in:
316316 (1) effective and systematic instructional practices
317317 in mathematics, including problem solving, the place value system,
318318 whole number operations, and fractions;
319319 (2) the underlying mathematical skills required to be
320320 taught; and
321321 (3) mathematical instruction techniques that, through
322322 scientific testing, have been proven effective.
323323 SECTION 8. Subchapter J, Chapter 21, Education Code, is
324324 amended by adding Section 21.4571 to read as follows:
325325 Sec. 21.4571. TEXAS ENGLISH LANGUAGE PROFICIENCY
326326 ASSESSMENT SYSTEM TRAINING. (a) The commissioner may not require a
327327 school district employee to repeat training the employee has
328328 previously successfully completed related to administering the
329329 Texas English Language Proficiency Assessment System, except that
330330 the commissioner may require the employee to complete training
331331 consisting of online calibration activities if the administration
332332 of or assessment using the Texas English Language Proficiency
333333 Assessment System has changed since the employee completed the
334334 training.
335335 (b) The school district employee assigned to oversee the
336336 administration of the Texas English Language Proficiency
337337 Assessment System at a district campus may, with discretion,
338338 require other district employees involved in administering the
339339 Texas English Language Proficiency Assessment System to complete
340340 training described by Subsection (a).
341341 (c) A school district employee may not be required to
342342 complete a training described by Subsection (a) in one sitting.
343343 SECTION 9. Sections 21.458(b) and (b-1), Education Code,
344344 are amended to read as follows:
345345 (b) The commissioner shall adopt rules necessary to
346346 administer this section, including rules concerning the duties and
347347 qualifications of a teacher who serves as a mentor and the number of
348348 classroom teachers that may be assigned to a mentor. The rules
349349 concerning qualifications must require that to serve as a mentor a
350350 teacher must:
351351 (1) complete a research-based mentor and induction
352352 training program approved by the commissioner;
353353 (2) complete a mentor training program provided by the
354354 district, which the district may allow to be satisfied by
355355 completing the training program described by Subdivision (1);
356356 (3) have at least three complete years of teaching
357357 experience with a superior record of assisting students, as a
358358 whole, in achieving improvement in student performance; and
359359 (4) demonstrate interpersonal skills, instructional
360360 effectiveness, and leadership skills.
361361 (b-1) A school district must provide training as described
362362 by Subsection (b)(2) to mentor teachers and any appropriate
363363 district and campus employees who work with the classroom teacher
364364 or supervise the classroom teacher. A district may allow a training
365365 program approved by the commissioner under Subsection (b)(1) to
366366 qualify for the training required by this section. The training
367367 must be completed by the mentor teacher and the district and campus
368368 employees before the beginning of the school year. The district
369369 shall also provide supplemental training to mentor teachers and
370370 employees during the school year. The training must include
371371 content related to best mentorship practices.
372372 SECTION 10. Section 22.902, Education Code, is amended by
373373 amending Subsection (a) and adding Subsection (c-1) to read as
374374 follows:
375375 (a) A school district shall [annually] make available to
376376 district employees and volunteers instruction in the principles and
377377 techniques of cardiopulmonary resuscitation and the use of an
378378 automated external defibrillator, as defined by Section 779.001,
379379 Health and Safety Code.
380380 (c-1) Each school district shall adopt procedures for each
381381 person required to be certified under Subsection (c) to submit
382382 proof of current certification. Procedures adopted by a district
383383 under this section must include the time and manner in which proof
384384 of current certification must be submitted.
385385 SECTION 11. Section 28.006(g-1), Education Code, is amended
386386 to read as follows:
387387 (g-1) A school district shall provide additional reading
388388 instruction and intervention to each student in seventh grade
389389 assessed under Subsection (c-1), as appropriate to improve the
390390 student's reading skills in the relevant areas identified through
391391 the assessment instrument. Training and support for activities
392392 required by this subsection shall be provided by regional education
393393 service centers and teacher literacy achievement [reading]
394394 academies established under Section 21.4552 [21.4551], and may be
395395 provided by other public and private providers.
396396 SECTION 12. Section 28.0062(a), Education Code, is amended
397397 to read as follows:
398398 (a) Each school district and open-enrollment charter school
399399 shall:
400400 (1) provide for the use of a phonics curriculum that
401401 uses systematic direct instruction in kindergarten through third
402402 grade to ensure all students obtain necessary early literacy
403403 skills;
404404 (2) ensure that:
405405 (A) not later than the 2022-2023 [2021-2022]
406406 school year, each classroom teacher in kindergarten or first,
407407 second, or third grade and each principal at a campus with
408408 kindergarten or first, second, or third grade has attended a
409409 teacher literacy achievement academy developed under Section
410410 21.4552; and
411411 (B) each classroom teacher and each principal
412412 initially employed in a grade level or at a campus described by
413413 Paragraph (A) for the 2022-2023 [2021-2022] school year or a
414414 subsequent school year has attended a teacher literacy achievement
415415 academy developed under Section 21.4552 before the teacher's or
416416 principal's first year of placement in that grade level or campus;
417417 and
418418 (3) certify to the agency that the district or school:
419419 (A) prioritizes placement of highly effective
420420 teachers in kindergarten through second grade; and
421421 (B) has integrated reading instruments used to
422422 diagnose reading development and comprehension to support each
423423 student in prekindergarten through third grade.
424424 SECTION 13. Section 29.063, Education Code, is amended by
425425 adding Subsection (e) to read as follows:
426426 (e) The agency may not require members of a language
427427 proficiency assessment committee to complete training to serve on
428428 that committee.
429429 SECTION 14. Sections 33.202(b) and (c), Education Code, are
430430 amended to read as follows:
431431 (b) The following persons must satisfactorily complete the
432432 safety training program in accordance with the frequency
433433 requirement adopted under Section 21.4515:
434434 (1) a coach, trainer, or sponsor for an
435435 extracurricular athletic activity; and
436436 (2) [except as provided by Subsection (f), a physician
437437 who is employed by a school or school district or who volunteers to
438438 assist with an extracurricular athletic activity; and
439439 [(3)] a director responsible for a school marching
440440 band.
441441 (c) The safety training program must include:
442442 (1) certification of participants by the American Red
443443 Cross, the American Heart Association, or a similar organization or
444444 by the University Interscholastic League;
445445 (2) current training in:
446446 (A) emergency action planning;
447447 (B) [cardiopulmonary resuscitation if the person
448448 is not required to obtain certification under Section 33.086;
449449 [(C)] communicating effectively with 9-1-1
450450 emergency service operators and other emergency personnel; and
451451 (C) [(D)] recognizing symptoms of potentially
452452 catastrophic injuries, including head and neck injuries,
453453 concussions, injuries related to second impact syndrome, asthma
454454 attacks, heatstroke, cardiac arrest, and injuries requiring use of
455455 a defibrillator; and
456456 (3) [at least once each school year,] a safety drill
457457 that incorporates the training described by Subdivision (2) and
458458 simulates various injuries described by Subdivision (2)(C)
459459 [(2)(D)].
460460 SECTION 15. Section 37.0831(b), Education Code, is amended
461461 to read as follows:
462462 (b) A dating violence policy must:
463463 (1) include a definition of dating violence that
464464 includes the intentional use of physical, sexual, verbal, or
465465 emotional abuse by a person to harm, threaten, intimidate, or
466466 control another person in a dating relationship, as defined by
467467 Section 71.0021, Family Code; and
468468 (2) address safety planning, enforcement of
469469 protective orders, school-based alternatives to protective orders,
470470 training for teachers and administrators at each district campus
471471 that instructs students in grade six or higher, counseling for
472472 affected students, and awareness education for students and
473473 parents.
474474 SECTION 16. Sections 38.0041(c) and (d), Education Code,
475475 are amended to read as follows:
476476 (c) The methods under Subsection (b)(1) for increasing
477477 awareness of issues regarding sexual abuse, sex trafficking, and
478478 other maltreatment of children must include training, as provided
479479 by this subsection, concerning prevention techniques for and
480480 recognition of sexual abuse, sex trafficking, and all other
481481 maltreatment of children, including the sexual abuse, sex
482482 trafficking, and other maltreatment of children with significant
483483 cognitive disabilities. The training:
484484 (1) must be provided in accordance with the frequency
485485 requirement adopted for the training under Section 21.4515 [, as
486486 part of a new employee orientation, to all new school district and
487487 open-enrollment charter school employees and to existing district
488488 and open-enrollment charter school employees on a schedule adopted
489489 by the agency by rule until all district and open-enrollment
490490 charter school employees have taken the training]; and
491491 (2) must include training concerning:
492492 (A) factors indicating a child is at risk for
493493 sexual abuse, sex trafficking, or other maltreatment;
494494 (B) likely warning signs indicating a child may
495495 be a victim of sexual abuse, sex trafficking, or other
496496 maltreatment;
497497 (C) internal procedures for seeking assistance
498498 for a child who is at risk for sexual abuse, sex trafficking, or
499499 other maltreatment, including referral to a school counselor, a
500500 social worker, or another mental health professional;
501501 (D) techniques for reducing a child's risk of
502502 sexual abuse, sex trafficking, or other maltreatment; and
503503 (E) community organizations that have relevant
504504 existing research-based programs that are able to provide training
505505 or other education for school district or open-enrollment charter
506506 school staff members, students, and parents.
507507 (d) For any training under Subsection (c), each school
508508 district and open-enrollment charter school shall maintain records
509509 that include the number [name] of [each] district or charter school
510510 staff members [member] who participated in the training.
511511 SECTION 17. Section 38.030(g), Education Code, is amended
512512 to read as follows:
513513 (g) The course of instruction for training described under
514514 Subsection (f) may [not] be provided as an online course. The
515515 course of instruction must use nationally recognized,
516516 evidence-based guidelines for bleeding control and must
517517 incorporate instruction on the psychomotor skills necessary to use
518518 a bleeding control station in the event of an injury to another
519519 person, including instruction on proper chest seal placement.
520520 SECTION 18. Section 38.036, Education Code, is amended by
521521 amending Subsections (c) and (d) and adding Subsection (c-1) to
522522 read as follows:
523523 (c) The methods under Subsection (b)(1) for increasing
524524 awareness and implementation of trauma-informed care must include
525525 training as provided by this subsection. The training must:
526526 (1) be provided:
527527 (A) [(1)] through a program selected from the
528528 list of recommended best practice-based programs and
529529 research-based practices established under Section 38.351
530530 [161.325, Health and Safety Code]; and
531531 (B) in accordance with the frequency requirement
532532 adopted for the training under Section 21.4515 [(2) as part of any
533533 new employee orientation for all new school district educators];
534534 and

541541 trained at intervals necessary to keep educators informed of
542542 developments in the field].
543543 (c-1) The training under Subsection (c) may include two or
544544 more listed topics together.
545545 (d) For any training under Subsection (c), each school
546546 district shall maintain records that include the number [name] of
547547 [each] district staff members [member] who participated in the
548548 training.
549549 SECTION 19. Section 38.210(b), Education Code, is amended
550550 to read as follows:
551551 (b) Training required under this section must:
552552 (1) include information on:
553553 (A) recognizing the signs and symptoms of
554554 anaphylaxis;
555555 (B) administering an epinephrine auto-injector;
556556 (C) implementing emergency procedures, if
557557 necessary, after administering an epinephrine auto-injector; and
558558 (D) properly disposing of used or expired
559559 epinephrine auto-injectors; [and]
560560 (2) be provided in a formal training session or
561561 through online education; and
562562 (3) be provided before the beginning of the school
563563 year or as soon as practicable following:
564564 (A) the enrollment of a student with a diagnosed
565565 food allergy at risk for anaphylaxis at a campus that previously had
566566 no students with a diagnosed food allergy at risk for anaphylaxis;
567567 or
568568 (B) a diagnosis of a student with a food allergy
569569 that makes the student at risk for anaphylaxis at a campus that
570570 previously had no students with a diagnosed food allergy at risk for
571571 anaphylaxis [and be completed annually].
572572 SECTION 20. Section 38.351(h), Education Code, is amended
573573 to read as follows:
574574 (h) If a school district provides the training under
575575 Subsection (g), the school district shall:
576576 (1) require completion of the training in accordance
577577 with the frequency requirement established for that training under
578578 Section 21.4515 [a school district employee described under that
579579 subsection must participate in the training at least one time]; and
580580 (2) [the school district shall] maintain records that
581581 include the number of [name of each] district employees [employee]
582582 who participated in the training.
583583 SECTION 21. Section 39.0304, Education Code, is amended by
584584 amending Subsection (a) and adding Subsections (b-1) and (b-2) to
585585 read as follows:
586586 (a) To ensure that each administration of assessment
587587 instruments under Section 39.023 is valid, reliable, and in
588588 compliance with the requirements of this subchapter, the
589589 commissioner may require training for school district employees
590590 involved in the administration of the assessment instruments,
591591 subject to Subsection (b-1).
592592 (b-1) The commissioner may only require the employee at each
593593 district campus who oversees the administration of the assessment
594594 instruments to annually receive the training required under
595595 Subsection (a).
596596 (b-2) The school district employee who oversees test
597597 administration on a district campus may, with discretion, require
598598 other district employees involved in the administration of
599599 assessment instruments to repeat the training under Subsection (a).
600600 SECTION 22. Section 39.408, Education Code, is amended to
601601 read as follows:
602602 Sec. 39.408. ELIGIBILITY CRITERIA FOR CERTAIN GRANT
603603 PROGRAMS. A school district or campus is eligible to participate in
604604 programs under Sections [21.4541,] 29.095[,] and 29.096 if the
605605 district or campus exhibited during each of the three preceding
606606 school years characteristics that strongly correlate with high
607607 dropout rates.
608608 SECTION 23. The following provisions of the Education Code
609609 are repealed:
610610 (1) Section 21.054(d-2), as amended by Chapter 464
611611 (S.B. 11) and Chapter 352 (H.B. 18), Acts of the 86th Legislature,
612612 Regular Session, 2019;
613613 (2) Section 21.054(e-2);
614614 (3) Section 21.454;
615615 (4) Section 21.4541;
616616 (5) Section 21.455;
617617 (6) Section 21.4551;
618618 (7) Section 21.4554;
619619 (8) Section 21.457;
620620 (9) Section 28.013(d);
621621 (10) Section 33.086;
622622 (11) Sections 33.202(d), (e), and (f);
623623 (12) Section 34.0021; and
624624 (13) Section 38.036(e).
625625 SECTION 24. To the extent of any conflict, this Act prevails
626626 over another Act of the 87th Legislature, Regular Session, 2021,
627627 relating to nonsubstantive additions to and corrections in enacted
628628 codes.
629629 SECTION 25. (a) Not later than June 1, 2022, the State
630630 Board for Educator Certification shall develop the continuing
631631 education and training clearinghouse required by Section 21.4514,
632632 Education Code, as added by this Act.
633633 (b) Not later than August 1, 2022, each school district
634634 shall establish frequency requirements for continuing education
635635 and training for district personnel in accordance with Section
636636 21.4515, Education Code, as added by this Act. District personnel
637637 who are required to complete continuing education or training that
638638 is subject to Section 21.4515, Education Code, as added by this Act,
639639 must complete the continuing education or training in accordance
640640 with the frequency requirement established under Section 21.4515,
641641 Education Code, as added by this Act, beginning with the 2022-2023
642642 school year.
643643 (c) Except as provided by Subsection (b) of this section,
644644 this Act applies beginning with the 2021-2022 school year.
645645 SECTION 26. This Act takes effect immediately if it
646646 receives a vote of two-thirds of all the members elected to each
647647 house, as provided by Section 39, Article III, Texas Constitution.
648648 If this Act does not receive the vote necessary for immediate
649649 effect, this Act takes effect September 1, 2021.
