55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the costs of expansion of open-enrollment charter
88 schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.266(f), Education Code, is amended to
1111 read as follows:
1212 (f) If the amount appropriated for the Foundation School
1313 Program for the second year of a state fiscal biennium is less than
1414 the amount to which school districts and open-enrollment charter
1515 schools are entitled for that year, the commissioner shall certify
1616 the amount of the difference to the Legislative Budget Board not
1717 later than January 1 of the second year of the state fiscal
1818 biennium. The Legislative Budget Board shall propose to the
1919 legislature that the certified amount be transferred to the
2020 foundation school fund from the economic stabilization fund and
2121 appropriated for the purpose of increases in allocations under this
2222 subsection. If the legislature fails during the regular session to
2323 enact the proposed transfer and appropriation and there are not
2424 funds available under Subsection (h), the commissioner may not
2525 approve an expansion amendment for an open-enrollment charter
2626 school and may not approve the application of a new charter holder
2727 for the biennium before adjusting [shall adjust] the total amounts
2828 due to each school district and open-enrollment charter school
2929 under this chapter and the total amounts necessary for each school
3030 district to comply with the requirements of Chapter 49 by an amount
3131 determined by applying to each district and school the same
3232 percentage adjustment to the total amount of state and local
3333 revenue due to the district or school under this chapter and Chapter
3434 49 so that the total amount of the adjustment to all districts and
3535 schools results in an amount equal to the total adjustment
3636 necessary. The following fiscal year:
3737 (1) a district's or school's entitlement under this
3838 section is increased by an amount equal to the adjustment made
3939 under this subsection; and
4040 (2) the amount necessary for a district to comply with
4141 the requirements of Chapter 49 is reduced by an amount necessary to
4242 ensure a district's full recovery of the adjustment made under this
4343 subsection.
4444 SECTION 2. Section 48.269(a), Education Code, is amended to
4545 read as follows:
4646 (a) Not later than October 1 of each even-numbered year:
4747 (1) the agency shall submit to the legislature:
4848 (A) an estimate of the tax rate and student
4949 enrollment of each school district for the following biennium; and
5050 (B) for each open-enrollment charter school, the
5151 school's student enrollment and the school's maximum enrollment
5252 capacity; and
5353 (2) the comptroller shall submit to the legislature an
5454 estimate of the total taxable value of all property in the state as
5555 determined under Subchapter M, Chapter 403, Government Code, for
5656 the following biennium.
5757 SECTION 3. This Act applies beginning with the 2021-2022
5858 school year.
5959 SECTION 4. This Act takes effect immediately if it receives
6060 a vote of two-thirds of all the members elected to each house, as
6161 provided by Section 39, Article III, Texas Constitution. If this
6262 Act does not receive the vote necessary for immediate effect, this
6363 Act takes effect September 1, 2021.
