55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the release of student directory information by a
88 public institution of higher education.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 51, Education Code, is
1111 amended by adding Section 51.9716 to read as follows:
1212 Sec. 51.9716. CONFIDENTIALITY OF STUDENT DIRECTORY
1313 INFORMATION. (a) In this section, "institution of higher
1414 education" has the meaning assigned by Section 61.003.
1515 (b) Except as provided by Subsection (c) and to provide
1616 privacy protections in addition to those provided under the Family
1717 Educational Rights and Privacy Act of 1974 (20 U.S.C. Section
1818 1232g), an institution of higher education may not sell or release
1919 information the institution designates as directory information
2020 about a student under that federal law, including the student's
2121 name, e-mail address, physical address, and telephone number,
2222 unless the student or the student's parent, if applicable, provides
2323 the institution written consent.
2424 (c) An institution of higher education is not prohibited
2525 from releasing designated directory information if the institution
2626 releases the information under an exception provided under the
2727 Family Educational Rights and Privacy Act of 1974 (20 U.S.C.
2828 Section 1232g(b)) for the release of education records without the
2929 written consent of a student or a student's parent, if applicable.
3030 SECTION 2. This Act takes effect September 1, 2021.
