| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 51.9716 to read as follows: |
|---|
| 12 | 12 | | Sec. 51.9716. CONFIDENTIALITY OF STUDENT DIRECTORY |
|---|
| 13 | 13 | | INFORMATION. (a) In this section, "institution of higher |
|---|
| 14 | 14 | | education" has the meaning assigned by Section 61.003. |
|---|
| 15 | 15 | | (b) Except as provided by Subsection (c) and to provide |
|---|
| 16 | 16 | | privacy protections in addition to those provided under the Family |
|---|
| 17 | 17 | | Educational Rights and Privacy Act of 1974 (20 U.S.C. Section |
|---|
| 18 | 18 | | 1232g), an institution of higher education may not sell or release |
|---|
| 19 | 19 | | information the institution designates as directory information |
|---|
| 20 | 20 | | about a student under that federal law, including the student's |
|---|
| 21 | 21 | | name, e-mail address, physical address, and telephone number, |
|---|
| 22 | 22 | | unless the student or the student's parent, if applicable, provides |
|---|
| 23 | 23 | | the institution written consent. |
|---|
| 24 | 24 | | (c) An institution of higher education is not prohibited |
|---|
| 25 | 25 | | from releasing designated directory information if the institution |
|---|
| 26 | 26 | | releases the information under an exception provided under the |
|---|
| 27 | 27 | | Family Educational Rights and Privacy Act of 1974 (20 U.S.C. |
|---|
| 28 | 28 | | Section 1232g(b)) for the release of education records without the |
|---|
| 29 | 29 | | written consent of a student or a student's parent, if applicable. |
|---|
| 30 | 30 | | SECTION 2. This Act takes effect September 1, 2021. |
