| 7 | 7 | | relating to bail bond surety advertising by a licensed attorney. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1704.303(b), Occupations Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | (b) A person may not advertise as a bail bond surety in a |
|---|
| 12 | 12 | | county unless the person holds a license issued under this chapter |
|---|
| 13 | 13 | | by a bail bond board in that county or the person is an attorney |
|---|
| 14 | 14 | | described by Section 1704.163(a). A person does not violate this |
|---|
| 15 | 15 | | subsection if the person places an advertisement that appears in |
|---|
| 16 | 16 | | more than one county and: |
|---|
| 17 | 17 | | (1) the advertisement clearly indicates the county or |
|---|
| 18 | 18 | | counties in which the person holds a license issued under this |
|---|
| 19 | 19 | | chapter; and |
|---|
| 20 | 20 | | (2) any local telephone number in the advertisement is |
|---|
| 21 | 21 | | a local number only for a county in which the person holds a license |
|---|
| 22 | 22 | | issued under this chapter. |
|---|
| 23 | 23 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 24 | 24 | | to an offense committed on or after the effective date of this Act. |
|---|
| 25 | 25 | | An offense committed before the effective date of this Act is |
|---|
| 26 | 26 | | governed by the law in effect on the date the offense was committed, |
|---|
| 27 | 27 | | and the former law is continued in effect for that purpose. For |
|---|
| 28 | 28 | | purposes of this section, an offense was committed before the |
|---|
| 29 | 29 | | effective date of this Act if any element of the offense occurred |
|---|
| 30 | 30 | | before that date. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2021. |
