55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to bail bond surety advertising by a licensed attorney.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1704.303(b), Occupations Code, is
1010 amended to read as follows:
1111 (b) A person may not advertise as a bail bond surety in a
1212 county unless the person holds a license issued under this chapter
1313 by a bail bond board in that county or the person is an attorney
1414 described by Section 1704.163(a). A person does not violate this
1515 subsection if the person places an advertisement that appears in
1616 more than one county and:
1717 (1) the advertisement clearly indicates the county or
1818 counties in which the person holds a license issued under this
1919 chapter; and
2020 (2) any local telephone number in the advertisement is
2121 a local number only for a county in which the person holds a license
2222 issued under this chapter.
2323 SECTION 2. The change in law made by this Act applies only
2424 to an offense committed on or after the effective date of this Act.
2525 An offense committed before the effective date of this Act is
2626 governed by the law in effect on the date the offense was committed,
2727 and the former law is continued in effect for that purpose. For
2828 purposes of this section, an offense was committed before the
2929 effective date of this Act if any element of the offense occurred
3030 before that date.
3131 SECTION 3. This Act takes effect September 1, 2021.
