| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter C, Chapter 574, Health and Safety |
|---|
| 12 | 12 | | Code, is amended by adding Sections 574.038 and 574.039 to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | Sec. 574.038. ESTABLISHMENT OF REGIONAL ASSISTED |
|---|
| 15 | 15 | | OUTPATIENT TREATMENT PROGRAMS. The commissioners courts of two or |
|---|
| 16 | 16 | | more counties may establish a regional assisted outpatient |
|---|
| 17 | 17 | | treatment program to provide court-ordered outpatient mental |
|---|
| 18 | 18 | | health services under this chapter in the participating counties. |
|---|
| 19 | 19 | | Sec. 574.039. PROGRAM IN CERTAIN COUNTIES MANDATORY. (a) |
|---|
| 20 | 20 | | The commissioners court of a county with a population of more than |
|---|
| 21 | 21 | | 200,000 shall undertake to establish a program under this chapter |
|---|
| 22 | 22 | | and apply for federal and state funding to cover program costs. The |
|---|
| 23 | 23 | | criminal justice division of the governor's office may assist a |
|---|
| 24 | 24 | | county in applying for federal funding. |
|---|
| 25 | 25 | | (b) A county is required to establish a program under this |
|---|
| 26 | 26 | | section only if the county receives federal or state funding |
|---|
| 27 | 27 | | specifically for that purpose in an amount sufficient to pay the |
|---|
| 28 | 28 | | program costs. |
|---|
| 29 | 29 | | (c) A county that is required to establish a program under |
|---|
| 30 | 30 | | this section and fails to establish or to maintain that program is |
|---|
| 31 | 31 | | ineligible to receive grant funding from this state or any state |
|---|
| 32 | 32 | | agency. |
|---|
| 33 | 33 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2021. |
