66 AN ACT
77 relating to the establishment of regional assisted outpatient
88 treatment programs to provide court-ordered outpatient mental
99 health services in certain counties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 574, Health and Safety
1212 Code, is amended by adding Sections 574.038 and 574.039 to read as
1313 follows:
1414 Sec. 574.038. ESTABLISHMENT OF REGIONAL ASSISTED
1515 OUTPATIENT TREATMENT PROGRAMS. The commissioners courts of two or
1616 more counties may establish a regional assisted outpatient
1717 treatment program to provide court-ordered outpatient mental
1818 health services under this chapter in the participating counties.
1919 Sec. 574.039. PROGRAM IN CERTAIN COUNTIES MANDATORY. (a)
2020 The commissioners court of a county with a population of more than
2121 200,000 shall undertake to establish a program under this chapter
2222 and apply for federal and state funding to cover program costs. The
2323 criminal justice division of the governor's office may assist a
2424 county in applying for federal funding.
2525 (b) A county is required to establish a program under this
2626 section only if the county receives federal or state funding
2727 specifically for that purpose in an amount sufficient to pay the
2828 program costs.
2929 (c) A county that is required to establish a program under
3030 this section and fails to establish or to maintain that program is
3131 ineligible to receive grant funding from this state or any state
3232 agency.
3333 SECTION 2. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2021.
