8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 142.003(a)(19), Health and Safety Code, | |
10 | 10 | is amended to read as follows: | |
11 | 11 | (19) a person that provides home health, hospice, | |
12 | 12 | habilitation, or personal assistance services only to persons | |
13 | 13 | receiving benefits under: | |
14 | 14 | (A) the home and community-based services (HCS) | |
15 | 15 | waiver program; | |
16 | 16 | (B) the Texas home living (TxHmL) waiver program; | |
17 | 17 | (C) the STAR + PLUS or other Medicaid managed | |
18 | 18 | care program under the program's HCS or TxHmL certification; or | |
19 | 19 | (D) the Intellectual and developmental | |
20 | 20 | disabilities habilitative specialized services (IHSS)program; | |
21 | 21 | (E) Section 534.152, Government Code; or | |
22 | 22 | SECTION 2. This Act takes effect September 1, 2021. |
