55 AN ACT
66 relating to the authority of a county to regulate impervious cover
77 around certain floodplains.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter Z, Chapter 240, Local Government
1010 Code, is amended by adding Section 240.911 to read as follows:
1111 Sec. 240.911. REGULATION OF IMPERVIOUS COVER AROUND CERTAIN
1212 FLOODPLAINS. The commissioners court of a county may regulate,
1313 including by adopting zoning regulations, impervious cover located
1414 in the unincorporated area of the county provided that area is also
1515 within 100 feet outside the 100-year floodplain of perennial and
1616 intermittent streams and rivers.
1717 SECTION 2. This Act takes effect immediately if it receives
1818 a vote of two-thirds of all the members elected to each house, as
1919 provided by Section 39, Article III, Texas Constitution. If this
2020 Act does not receive the vote necessary for immediate effect, this
2121 Act takes effect September 1, 2021.
