8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Subchapter Z, Chapter 240, Local Government | |
10 | 10 | Code, is amended by adding Section 240.911 to read as follows: | |
11 | 11 | Sec. 240.911. REGULATION OF IMPERVIOUS COVER AROUND CERTAIN | |
12 | 12 | FLOODPLAINS. The commissioners court of a county may regulate, | |
13 | 13 | including by adopting zoning regulations, impervious cover located | |
14 | 14 | in the unincorporated area of the county provided that area is also | |
15 | 15 | within 100 feet outside the 100-year floodplain of perennial and | |
16 | 16 | intermittent streams and rivers. | |
17 | 17 | SECTION 2. This Act takes effect immediately if it receives | |
18 | 18 | a vote of two-thirds of all the members elected to each house, as | |
19 | 19 | provided by Section 39, Article III, Texas Constitution. If this | |
20 | 20 | Act does not receive the vote necessary for immediate effect, this | |
21 | 21 | Act takes effect September 1, 2021. |
