55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to animal disease control by the Texas Animal Health
88 Commission; providing an administrative penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 161.041(a), Agriculture Code, is amended
1111 to read as follows:
1212 (a) The commission shall protect all livestock, exotic
1313 livestock, domestic fowl, and exotic fowl from the following:
1414 (1) tuberculosis;
1515 (2) anthrax;
1616 (3) glanders;
1717 (4) brucellosis [infectious abortion];
1818 (5) hemorrhagic septicemia;
1919 (6) classical swine fever [hog cholera];
2020 (7) [Malta fever;
2121 [(8)] foot-and-mouth disease;
2222 (8) [(9)] rabies among animals other than canines;
2323 (9) pullorum disease [(10) bacillary white diarrhea
2424 among fowl];
2525 (10) [(11)] equine infectious anemia; [and]
2626 (11) fowl typhoid;
2727 (12) scabies; and
2828 (13) [(12)] other diseases recognized as communicable
2929 by the veterinary profession.
3030 SECTION 2. Section 161.0415(a), Agriculture Code, is
3131 amended to read as follows:
3232 (a) The commission by order may require the slaughter of
3333 livestock, domestic fowl, or exotic fowl, under the direction of
3434 the commission, or the sale of livestock, domestic fowl, or exotic
3535 fowl for immediate slaughter at a public slaughtering establishment
3636 maintaining federal or state inspection if the livestock, domestic
3737 fowl, or exotic fowl is exposed to or infected with a disease other
3838 than bluetongue or vesicular stomatitis that:
3939 (1) is recognized by the United States Department of
4040 Agriculture as:
4141 (A) a foreign animal disease; or
4242 (B) a reportable animal disease;
4343 (2) is the subject of a cooperative eradication
4444 program with the United States Department of Agriculture;
4545 (3) is an animal disease reportable to the World
4646 Organisation for Animal Health [named on "List A" of the Office
4747 International Des Epizooties]; or
4848 (4) is the subject of a state of emergency, as declared
4949 by the governor.
5050 SECTION 3. Section 161.061, Agriculture Code, is amended by
5151 amending Subsection (a) and adding Subsection (d) to read as
5252 follows:
5353 (a) If the commission determines or is informed that a
5454 disease listed in Section 161.041 [of this code] exists in another
5555 state, territory, or country, the commission may [shall] establish
5656 a quarantine against all or the portion of the state, territory, or
5757 country in which the disease exists.
5858 (d) The commission by rule may delegate its authority to
5959 establish a quarantine under this section to the executive
6060 director, who shall promptly notify the members of the commission
6161 when a quarantine is established.
6262 SECTION 4. Sections 161.101(a) and (b), Agriculture Code,
6363 are amended to read as follows:
6464 (a) A veterinarian, a veterinary diagnostic laboratory, or
6565 a person having care, custody, or control of an animal shall report
6666 the existence of the following diseases among livestock, exotic
6767 livestock, bison, domestic fowl, or exotic fowl to the commission
6868 within 24 hours after diagnosis of the disease:
6969 (1) anthrax;
7070 (2) avian chlamydiosis;
7171 (3) avian infectious laryngotracheitis;
7272 (4) [(3)] avian influenza;
7373 [(4) avian tuberculosis;]
7474 (5) bovine trichomoniasis;
7575 (6) chronic wasting disease;
7676 (7) duck virus enteritis;
7777 (8) duck virus hepatitis;
7878 (9) equine encephalomyelitis;
7979 (10) equine herpesvirus-1 [herpes virus-1];
8080 (11) equine infectious anemia;
8181 (12) equine viral arteritis;
8282 (13) infectious encephalomyelitis in poultry or other
8383 fowl;
8484 (14) [ornithosis;
8585 [(15)] paramyxovirus infection in poultry or other
8686 fowl; [or]
8787 (15) [(16)] scabies in sheep or cattle;
8888 (16) Schmallenberg virus; or
8989 (17) tuberculosis.
9090 (b) In addition to reporting required by Subsection (a), the
9191 commission may adopt rules that require a veterinarian, a
9292 veterinary diagnostic laboratory, or a person having care, custody,
9393 or control of an animal to report the existence of a disease other
9494 than bluetongue in an animal to the commission within 24 hours after
9595 diagnosis if the disease:
9696 (1) is recognized by the United States Department of
9797 Agriculture as:
9898 (A) a foreign animal disease; or
9999 (B) a reportable animal disease;
100100 (2) is the subject of a cooperative eradication
101101 program with the United States Department of Agriculture;
102102 (3) is an animal [a] disease reportable to the World
103103 Organisation for Animal Health [Office International Des
104104 Epizooties]; or
105105 (4) is the subject of a state of emergency, as declared
106106 by the governor.
107107 SECTION 5. Sections 161.148(a) and (d), Agriculture Code,
108108 are amended to read as follows:
109109 (a) The commission may impose an administrative penalty on
110110 [against] a person who violates this subtitle or a rule or order
111111 adopted under this subtitle.
112112 (d) If the [An] executive director [who] determines that a
113113 violation has occurred, the director may issue to the commission a
114114 report that states the facts on which the determination is based and
115115 the director's recommendation on the imposition of a penalty,
116116 including a recommendation on the amount of the penalty.
117117 SECTION 6. This Act takes effect September 1, 2021.
