| 5 | 11 | | relating to administrative penalties imposed by the Texas Animal |
|---|
| 6 | 12 | | Health Commission. |
|---|
| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Sections 161.148(a) and (b), Agriculture Code, |
|---|
| 9 | 15 | | are amended to read as follows: |
|---|
| 10 | 16 | | (a) The commission may impose an administrative penalty on |
|---|
| 11 | 17 | | [against] a person who violates this subtitle or a rule or order |
|---|
| 12 | 18 | | adopted under this subtitle. |
|---|
| 13 | 19 | | (b) The penalty for a violation may be in an amount not to |
|---|
| 14 | 20 | | exceed $5,000 [$1,000]. Each day a violation continues or occurs is |
|---|
| 15 | 21 | | a separate violation for purposes of imposing a penalty. The amount |
|---|
| 16 | 22 | | of the penalty shall not be based on a per head basis. |
|---|
| 17 | 23 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 18 | 24 | | a violation committed on or after the effective date of this Act. A |
|---|
| 19 | 25 | | violation committed before the effective date of this Act is |
|---|
| 20 | 26 | | governed by the law in effect when the violation was committed, and |
|---|
| 21 | 27 | | the former law is continued in effect for that purpose. For |
|---|
| 22 | 28 | | purposes of this section, a violation was committed before the |
|---|
| 23 | 29 | | effective date of this Act if any element of the violation occurred |
|---|
| 24 | 30 | | before that date. |
|---|
| 25 | 31 | | SECTION 3. This Act takes effect September 1, 2021. |
