55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the establishment of a task force to study the effect of
88 delayed school start times on students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. DEFINITIONS. In this Act:
1111 (1) "Agency" means the Texas Education Agency.
1212 (2) "Commissioner" means the commissioner of
1313 education.
1414 (3) "Task force" means the task force established
1515 under this Act.
1616 SECTION 2. TASK FORCE TO STUDY SCHOOL DAY START TIMES. (a)
1717 A task force is established under this section to study the effect
1818 of school day start times on students in kindergarten through grade
1919 12.
2020 (b) The commissioner shall appoint members of the task
2121 force, including:
2222 (1) one pediatrician;
2323 (2) one physician who specializes in sleep disorders;
2424 (3) one mental health professional who specializes in
2525 adolescent health issues;
2626 (4) one representative of the National Alliance on
2727 Mental Illness;
2828 (5) one representative of the Texas Psychology
2929 Association;
3030 (6) one representative of Every Texan;
3131 (7) one representative of Raise Your Hand Texas;
3232 (8) one representative of Start School Later Texas;
3333 (9) one representative of the Texas Pediatric Society;
3434 (10) one representative of the Texas School Health
3535 Advisory Committee;
3636 (11) one representative of the Texas Association of
3737 School Administrators;
3838 (12) one representative of the Texas Professional
3939 Educators;
4040 (13) one representative of the Texas School Nurses
4141 Organization;
4242 (14) one representative of the Texas Principals
4343 Association;
4444 (15) one representative of the Texas Association for
4545 Pupil Transportation;
4646 (16) one student enrolled in public school in this
4747 state;
4848 (17) one representative of the American Academy of
4949 Child and Adolescent Psychiatry;
5050 (18) one representative of the American Academy of
5151 Pediatrics;
5252 (19) one representative of the American Academy of
5353 Sleep Medicine;
5454 (20) one representative of the American Medical
5555 Association;
5656 (21) one representative of Goose Creek Consolidated
5757 Independent School District;
5858 (22) one representative of the Centers for Disease
5959 Control and Prevention;
6060 (23) one representative of Texas Children's Hospital;
6161 (24) one representative of Texas Tech University
6262 Health Science Center;
6363 (25) one representative of University of Texas Medical
6464 Branch;
6565 (26) one representative of Circadian Sleep Disorders
6666 Network;
6767 (27) one representative of Sleep Medicine and
6868 Neurology Consultants;
6969 (28) one representative of Children's Health Dallas;
7070 (29) one representative of the League of Women Voters
7171 of Tarrant County;
7272 (30) one representative of the National Education
7373 Association;
7474 (31) one representative of the National Parent Teacher
7575 Association;
7676 (32) one representative of Deer Park Independent
7777 School District; and
7878 (33) one representative of the Society of Pediatric
7979 Nurses.
8080 (c) The members of the task force shall select the presiding
8181 officer of the task force.
8282 (d) The presiding officer shall call the initial meeting of
8383 the task force not later than January 1, 2022. The task force shall
8484 meet at the times and places that the presiding officer determines
8585 are appropriate. The task force shall adopt rules necessary to
8686 fulfill the task force's duties under this section.
8787 (e) Chapter 2110, Government Code, does not apply to the
8888 task force.
8989 SECTION 3. DUTIES OF THE TASK FORCE. The task force shall:
9090 (1) conduct a study that:
9191 (A) evaluates the effect of daily school start
9292 and end times on students in kindergarten through grade 12;
9393 (B) considers any negative impacts on public and
9494 private school students and families that may arise from delayed
9595 daily school start and end times;
9696 (C) evaluates studies or initiatives relating to
9797 school start times that are supported by national education
9898 advocacy organizations; and
9999 (D) reviews any available literature regarding
100100 the experience of students in other states that have delayed school
101101 day start times;
102102 (2) prepare an assessment on the effect of delayed
103103 school day start times on the health, safety, and academic
104104 performance of students; and
105105 (3) provide recommendations to the agency regarding
106106 the feasibility of establishing a pilot program to test delayed
107107 school day start times.
108108 SECTION 4. REPORT. Not later than December 31, 2022, the
109109 task force shall deliver a report to the commissioner of education
110110 that includes the findings from the study, a summary of information
111111 considered for the purposes of the study, and the recommendations
112112 on the feasibility of a pilot program.
113113 SECTION 5. EXPIRATION. The task force is abolished and this
114114 Act expires January 1, 2023.
115115 SECTION 6. EFFECTIVE DATE. This Act takes effect September
116116 1, 2021.
