7 | 7 | | Commission of Texas to facilitate the movement of natural gas to |

8 | 8 | | high priority customers during periods of emergency. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Amend Subchapter C, Natural Resources Code by |
---|
11 | 11 | | adding a new Section 82.01 to read as follows: |
---|
12 | 12 | | Sec 81.073 CREATION OF ADVISORY COMMITTEE TO FACILITATE THE |
---|
13 | 13 | | MOVEMENT OF NATURAL GAS TO HUMAN NEEDS CUSTOMERS DURING AN |
---|
14 | 14 | | EMERGENCY. (a) The Railroad Commission will establish an advisory |
---|
15 | 15 | | committee to be known as the Texas Energy Reliability Council |
---|
16 | 16 | | (TERC) to coordinate and facilitate natural gas supplies to human |
---|
17 | 17 | | needs and other high priority needs during emergencies when the |
---|
18 | 18 | | supply of natural gas may not be sufficient to meet the demand for |
---|
19 | 19 | | natural gas. It may establish the TERC by either adopting a rule or |
---|
20 | 20 | | by entering an order |
---|
21 | 21 | | (b) The Railroad Commission will appoint the members of the |
---|
22 | 22 | | TERC to include at least the following: |
---|
23 | 23 | | (1) representatives of state agencies or other |
---|
24 | 24 | | governmental entities that the Railroad Commission determines will |
---|
25 | 25 | | be necessary or useful in accomplishing the goals of the TERC; |
---|
26 | 26 | | (2) entities which operate facilities essential or |
---|
27 | 27 | | useful to the natural gas supply chain; |
---|
28 | 28 | | (3) entities which operate facilities essential or |
---|
29 | 29 | | useful to the provision of electric power to human needs customer; |
---|
30 | 30 | | (4) organizations or individuals with useful |
---|
31 | 31 | | knowledge of the natural has supply chain or the provision of |
---|
32 | 32 | | electric power to the public. |
---|
33 | 33 | | (c) The Railroad Commission is authorized to convene the |
---|
34 | 34 | | TERC at such time and places and in such manner as it deems |
---|
35 | 35 | | necessary or useful in accomplishing the goals of TERC. |
---|
36 | 36 | | (d) The Railroad Commission will appoint a Chairman from |
---|
37 | 37 | | among the members it appoints |
---|
38 | 38 | | (e) Chapter 2110 Government Code does not apply to the |
---|
39 | 39 | | Commission or the TERC with regard to the creation or operation of |
---|
40 | 40 | | TERC. |
---|
41 | 41 | | (f) The TERC is not a governmental entity subject to |
---|
42 | 42 | | Chapters 551 or 552 of the Government Code. |
---|
43 | 43 | | (g) The Railroad Commission shall adopt such rules as it |
---|
44 | 44 | | deems necessary or useful with regard to the organization and |
---|
45 | 45 | | operation of the TERC. |
---|
46 | 46 | | SECTION 3. This Act takes effect immediately if it receives |
---|
47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
---|
48 | 48 | | provided by Section 39, Article II, Texas Constitution. If this Act |
---|
49 | 49 | | does not receive the vote necessary for immediate effect, this Act |
---|
50 | 50 | | takes effect September 1, 2021. |
