| 10 | 10 | SECTION 1. Subchapter B, Chapter 92, Property Code, is | |
| 11 | 11 | amended by adding Section 92.0521 to read as follows: | |
| 12 | 12 | Sec. 92.0521. LANDLORD'S DUTY TO INSPECT FOR AND TREAT | |
| 13 | 13 | BEDBUGS; DISCLOSURE. (a) Except as provided by Subsection (b), | |
| 14 | 14 | during a tenant's lease term or during a renewal or extension, the | |
| 15 | 15 | landlord has a duty to inspect and treat, at the landlord's expense, | |
| 16 | 16 | the leased premises for bedbugs. | |
| 17 | 17 | (b) A tenant may decline in writing the landlord's | |
| 18 | 18 | inspection for and treatment of bedbugs under Subsection (a). | |
| 19 | 19 | (c) A provision stating the landlord's duty under this | |
| 20 | 20 | section must be included in a lease agreement signed by the tenant. | |
| 21 | 21 | SECTION 2. Section 92.0521, Property Code, as added by this | |
| 22 | 22 | Act, applies only to a lease entered into or renewed on or after the | |
| 23 | 23 | effective date of this Act. | |
| 24 | 24 | SECTION 3. This Act takes effect September 1, 2021. |
