117 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12- SECTION 1. The heading to Section 113.095, Natural
13- Resources Code, is amended to read as follows:
14- Sec. 113.095. LICENSE AND EXAMINATION BY ENDORSEMENT:
15- OUT-OF-STATE LICENSE OR CERTIFICATION.
16- SECTION 2. Subchapter D, Chapter 113, Natural Resources
17- Code, is amended by adding Section 113.0955 to read as follows:
18- Sec. 113.0955. LICENSE AND EXAMINATION BY ENDORSEMENT:
19- NATIONALLY RECOGNIZED TRAINING. The commission by rule shall waive
20- the requirements of Section 113.087 for an applicant for a license
21- for cylinder filling who:
22- (1) has completed training consistent with the
23- guidelines established by the Propane Education & Research Council;
24- (2) submits proof of completion of training described
25- by Subdivision (1);
26- (3) submits an application for that type of license;
27- and
28- (4) pays the applicable original nonrefundable
29- license fee as established by the commission under Section 113.082.
30- SECTION 3. This Act takes effect September 1, 2021.
8+ SECTION 1. Section 113.095, Natural Resource Code, is
9+ amended to read as follows:
10+ Sec. 113.095. LICENSE AND EXAMINATION BY ENDORSEMENT. (a)
11+ The commission may waive any license requirement for an applicant
12+ with a valid license from another state having license requirements
13+ substantially equivalent to those of this state, or an applicant
14+ who has completed training under guidelines established by the
15+ Propane Education and Research Council ("PERC").
16+ (b) The commission by rule may waive the requirements of
17+ Section 113.087 for an applicant holding a valid examination
18+ certificate issued by another state having certification
19+ requirements substantially equivalent to those of this state.
20+ (c) The commission shall waive the requirements of Section
21+ 113.087 for an applicant who has completed training under
22+ guidelines established by PERC and submits proof of completion of
23+ training.
24+ (d) An applicant who has completed training under
25+ guidelines established by PERC shall also submit the required
26+ application together with the original nonrefundable license fee
27+ established by the commission under Section 113.082 and proof of
28+ completion of training.
29+ (e) An applicant who satisfies the provisions of this
30+ subchapter may engage in the activities set forth in this chapter
31+ just as one who receives a license in this state.
32+ SECTION 2. This Act takes effect immediately if it receives
33+ a vote of two-thirds of all the members elected to each house, as
34+ provided by Section 39, Article III, Texas Constitution. If this
35+ Act does not receive the vote necessary for immediate effect, this
36+ Act takes effect September 1, 2021.
