55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definitions of bullying and harassment and the
88 behavior of students in public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.001(b)(2), Education Code, is amended
1111 to read as follows:
1212 (2) "Harassment":
1313 (A) means threatening to cause harm or bodily
1414 injury to another student, engaging in sexually intimidating
1515 conduct, causing physical damage to the property of another
1616 student, subjecting another student to physical confinement or
1717 restraint, or maliciously taking any action that substantially
1818 harms another student's physical or emotional health or safety; and
1919 (B) includes conduct described by Paragraph (A)
2020 that is based on the actual or perceived race, color, national
2121 origin, sex, disability, sexual orientation, gender identity or
2222 expression, religion, or any other distinguishing characteristic
2323 of a student or of a person with whom a student associates.
2424 SECTION 2. Section 37.0832(a)(1), Education Code, is
2525 amended to read as follows:
2626 (1) "Bullying":
2727 (A) means a single significant act or a pattern
2828 of acts by one or more students directed at another student that
2929 exploits an imbalance of power and involves engaging in written or
3030 verbal expression, expression through electronic means, or
3131 physical conduct that satisfies the applicability requirements
3232 provided by Subsection (a-1), and that:
3333 (i) has the effect or will have the effect
3434 of physically harming a student, damaging a student's property, or
3535 placing a student in reasonable fear of harm to the student's person
3636 or of damage to the student's property;
3737 (ii) is sufficiently severe, persistent, or
3838 pervasive enough that the action or threat creates an intimidating,
3939 threatening, or abusive educational environment for a student;
4040 (iii) materially and substantially
4141 disrupts the educational process or the orderly operation of a
4242 classroom or school; or
4343 (iv) infringes on the rights of the victim
4444 at school; and
4545 (B) includes:
4646 (i) cyberbullying; and
4747 (ii) conduct described by Paragraph (A)
4848 that is based on the actual or perceived race, color, national
4949 origin, sex, disability, sexual orientation, gender identity or
5050 expression, religion, or any other distinguishing characteristic
5151 of a student or of a person with whom a student associates.
5252 SECTION 3. This Act applies beginning with the 2021-2022
5353 school year.
5454 SECTION 4. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2021.
