9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 28.014, Education Code, is amended by |
---|
11 | 11 | | amending Subsection (a) and adding Subsection (a-1) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (a) Each school district shall partner with at least one |
---|
14 | 14 | | institution of higher education to develop and provide courses in |
---|
15 | 15 | | college preparatory mathematics and English language arts. The |
---|
16 | 16 | | courses must be designed: |
---|
17 | 17 | | (1) subject to Subsection (a-1), for students at the |
---|
18 | 18 | | 11th and 12th grade levels [level] whose performance on: |
---|
19 | 19 | | (A) an end-of-course assessment instrument |
---|
20 | 20 | | required under Section 39.023(c) does not meet college readiness |
---|
21 | 21 | | standards; or |
---|
22 | 22 | | (B) coursework, a college entrance examination, |
---|
23 | 23 | | or an assessment instrument designated under Section 51.334 |
---|
24 | 24 | | indicates that the student is not ready to perform entry-level |
---|
25 | 25 | | college coursework; and |
---|
26 | 26 | | (2) to prepare students for success in entry-level |
---|
27 | 27 | | college courses. |
---|
28 | 28 | | (a-1) A student at the 11th grade level may take a course |
---|
29 | 29 | | provided under Subsection (a) if the student demonstrates to an |
---|
30 | 30 | | appropriate campus administrator that the student would otherwise |
---|
31 | 31 | | be unable to take the course during the student's 12th grade year |
---|
32 | 32 | | and complete the curriculum requirements for high school |
---|
33 | 33 | | graduation. |
---|
34 | 34 | | SECTION 2. This Act applies beginning with the 2021-2022 |
---|
35 | 35 | | school year. |
---|
36 | 36 | | SECTION 3. This Act takes effect immediately if it receives |
---|
37 | 37 | | a vote of two-thirds of all the members elected to each house, as |
---|
38 | 38 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
39 | 39 | | Act does not receive the vote necessary for immediate effect, this |
---|
40 | 40 | | Act takes effect September 1, 2021. |
