118 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
129 Section 1. Section 25.0172 (p), Government Code, is amended
1310 to read as follows:
1411 (p) The county clerk shall keep a separate docket for each
1512 county court at law. The county clerk shall appoint a deputy clerk
16- for each county court at law. [An appointment of a deputy clerk of
13+ for each county court at law. An appointment of a deputy clerk of
1714 County Court at Law No. 2 or 3 takes effect when it is confirmed in
1815 writing by the judge of the court to which the deputy clerk is
1916 assigned and the deputy clerk serves at the pleasure of the judge of
20- the court to which he is assigned.] A deputy clerk must take the
17+ the court to which he is assigned. A deputy clerk must take the
2118 constitutional oath of office and may be required to furnish bond in
2219 an amount, conditioned and payable, as required by the county
2320 clerk. A deputy clerk must attend all sessions of the court to
24- which the deputy clerk [he] is assigned. A deputy clerk acts in the
25- name of the county clerk and may perform any official act or service
26- required of the county clerk and shall perform any other service
27- required by the judge of a county court at law. The deputy clerks
28- may act for one another in performing services for the county courts
29- at law, but a deputy is not entitled to receive additional
30- compensation for acting for another deputy. If a vacancy occurs,
31- the county clerk shall immediately appoint another deputy clerk as
32- provided by this subsection. [A deputy clerk of a county court at
33- law is entitled to the same amount of compensation as received by
34- the deputy clerks of the other county courts at law in Bexar County.
35- The commissioners court shall pay the salary of a deputy clerk in
36- equal monthly installments from county funds.]
37- SECTION 2. This Act takes effect immediately if it receives
38- a vote of two-thirds of all the members elected to each house, as
39- provided by Section 39, Article III, Texas Constitution. If this
40- Act does not receive the vote necessary for immediate effect, this
41- Act takes effect September 1, 2021.
