69 relating to the designation of certain premises as critical load
710 premises for electric service.
811 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
912 SECTION 1. Subchapter D, Chapter 38, Utilities Code, is
1013 amended by adding Section 38.074 to read as follows:
1114 Sec. 38.074. CRITICAL LOAD PREMISES DESIGNATION. (a) The
1215 commission by rule shall establish a process for a transmission and
1316 distribution utility to designate and prioritize the designation of
1417 certain premises as critical load premises and adopt criteria for
1518 determining eligibility for the designation and priority. In
1619 establishing the process and adopting the criteria, the commission
1720 shall coordinate with other agencies that have primary jurisdiction
1821 over entities that own or operate premises that may be designated as
1922 critical load premises.
2023 (b) The eligibility criteria adopted under Subsection (a)
21- must allow for premises used by the following entities or for the
22- following activities to be eligible to be designated as critical
23- load premises:

25+ eligible to be designated as critical load premises:
2426 (1) upstream natural gas production;
2527 (2) midstream natural gas transportation;
26- (3) gas utilities;
27- (4) fuel production;
28- (5) nitrogen supply;
29- (6) hydrogen supply;
30- (7) water supply;
31- (8) wastewater treatment; and
32- (9) telecommunications.

3333 (c) Annually, the commission shall submit to the
3434 legislature a report regarding critical load premises
3535 designations, including analysis of the implementation and results
3636 of the designations.
37- (d) This section does not limit a transmission and
38- distribution utility's discretion to prioritize power delivery and
39- power restoration to the transmission and distribution utility's
40- customers as circumstances require.
4137 SECTION 2. Not later than January 1, 2022, the Public
4238 Utility Commission of Texas shall submit to the legislature the
4339 first report required by Section 38.074, Utilities Code, as added
4440 by this Act.
4541 SECTION 3. If this Act takes effect immediately, the Public
4642 Utility Commission of Texas shall adopt the rules required by
4743 Section 38.074, Utilities Code, as added by this Act, not later than
4844 September 1, 2021. If this Act takes effect September 1, 2021, the
4945 Public Utility Commission of Texas shall adopt rules as required by
5046 Section 38.074, Utilities Code, as added by this Act, not later than
5147 November 1, 2021.
5248 SECTION 4. This Act takes effect immediately if it receives
5349 a vote of two-thirds of all the members elected to each house, as
5450 provided by Section 39, Article III, Texas Constitution. If this
5551 Act does not receive the vote necessary for immediate effect, this
5652 Act takes effect September 1, 2021.
