5	8		AN ACT
6	9		relating to the designation of certain premises as critical load
7	10		premises for electric service.
8	11		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	12		SECTION 1. Subchapter D, Chapter 38, Utilities Code, is
10	13		amended by adding Section 38.074 to read as follows:
11	14		Sec. 38.074. CRITICAL LOAD PREMISES DESIGNATION. (a) The
12	15		commission by rule shall establish a process for a transmission and
13	16		distribution utility to designate and prioritize the designation of
14	17		certain premises as critical load premises and adopt criteria for
15	18		determining eligibility for the designation and priority. In
16	19		establishing the process and adopting the criteria, the commission
17	20		shall coordinate with other agencies that have primary jurisdiction
18	21		over entities that own or operate premises that may be designated as
19	22		critical load premises.
20	23		(b) The eligibility criteria adopted under Subsection (a)
21		-	must allow for premises used by the following entities or for the
22		-	following activities to be eligible to be designated as critical
23		-	load premises:

33	33		(c) Annually, the commission shall submit to the
34	34		legislature a report regarding critical load premises
35	35		designations, including analysis of the implementation and results
36	36		of the designations.
37		-	(d) This section does not limit a transmission and
38		-	distribution utility's discretion to prioritize power delivery and
39		-	power restoration to the transmission and distribution utility's
40		-	customers as circumstances require.
41	37		SECTION 2. Not later than January 1, 2022, the Public
42	38		Utility Commission of Texas shall submit to the legislature the
43	39		first report required by Section 38.074, Utilities Code, as added
44	40		by this Act.
45	41		SECTION 3. If this Act takes effect immediately, the Public
46	42		Utility Commission of Texas shall adopt the rules required by
47	43		Section 38.074, Utilities Code, as added by this Act, not later than
48	44		September 1, 2021. If this Act takes effect September 1, 2021, the
49	45		Public Utility Commission of Texas shall adopt rules as required by
50	46		Section 38.074, Utilities Code, as added by this Act, not later than
51	47		November 1, 2021.
52	48		SECTION 4. This Act takes effect immediately if it receives
53	49		a vote of two-thirds of all the members elected to each house, as
54	50		provided by Section 39, Article III, Texas Constitution. If this
55	51		Act does not receive the vote necessary for immediate effect, this
56	52		Act takes effect September 1, 2021.
