87 relating to discrimination on the basis of hair texture or
98 protective hairstyle associated with race.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Subchapter Z, Chapter 25, Education Code, is
1211 amended by adding Section 25.902 to read as follows:
1312 Sec. 25.902. PROHIBITION ON CERTAIN DISCRIMINATION IN
1413 STUDENT DRESS OR GROOMING POLICY. (a) In this section, "protective
1514 hairstyle" includes braids, locks, and twists.
1615 (b) Any student dress or grooming policy adopted by a school
1716 district, including a student dress or grooming policy for any
1817 extracurricular activity, may not discriminate against a hair
1918 texture or protective hairstyle commonly or historically
2019 associated with race.
2120 SECTION 2. Subchapter Z, Chapter 51, Education Code, is
2221 amended by adding Section 51.979 to read as follows:
2322 Sec. 51.979. PROHIBITION ON CERTAIN DISCRIMINATION IN
2423 STUDENT DRESS OR GROOMING POLICY. (a) In this section:
2524 (1) "Institution of higher education" has the meaning
2625 assigned by Section 61.003.
2726 (2) "Protective hairstyle" includes braids, locks,
2827 and twists.
2928 (b) Any student dress or grooming policy adopted by an
3029 institution of higher education, including a student dress or
3130 grooming policy for any extracurricular activity, may not
3231 discriminate against a hair texture or protective hairstyle
3332 commonly or historically associated with race.
3433 SECTION 3. Subchapter C, Chapter 21, Labor Code, is amended
3534 by adding Section 21.1095 to read as follows:
3635 Sec. 21.1095. RACIAL DISCRIMINATION BASED ON HAIR TEXTURE
3736 OR PROTECTIVE HAIRSTYLE. (a) In this section, "protective
3837 hairstyle" includes braids, locks, and twists.
3938 (b) A provision in this chapter referring to discrimination
4039 because of race or on the basis of race includes discrimination
4140 because of or on the basis of an employee's hair texture or
4241 protective hairstyle commonly or historically associated with
4342 race.
4443 (c) An employer, labor union, or employment agency commits
4544 an unlawful employment practice if the employer, labor union, or
4645 employment agency adopts or enforces a dress or grooming policy
4746 that discriminates against a hair texture or protective hairstyle
4847 commonly or historically associated with race.
4948 SECTION 4. Subchapter A, Chapter 301, Property Code, is
5049 amended by adding Section 301.0045 to read as follows:
5150 Sec. 301.0045. RACIAL DISCRIMINATION BASED ON HAIR TEXTURE
5251 OR PROTECTIVE HAIRSTYLE. (a) In this section, "protective
5352 hairstyle" includes braids, locks, and twists.
5453 (b) A provision in this chapter, other than a provision in
5554 Subchapter I, referring to discrimination because of race or on the
5655 basis of race includes discrimination because of or on the basis of
5756 a person's hair texture or protective hairstyle commonly or
5857 historically associated with race.
5958 SECTION 5. Section 21.1095, Labor Code, as added by this
6059 Act, applies only to an unlawful employment practice that occurs on
6160 or after the effective date of this Act.
6261 SECTION 6. Section 301.0045, Property Code, as added by
6362 this Act, applies only to a discriminatory housing practice that
6463 occurs on or after the effective date of this Act.
6564 SECTION 7. This Act takes effect September 1, 2021.
