7 | 7 | | relating to the use of certain drugs in bovine breeding stock by or |

8 | 8 | | on the prescription of a veterinarian. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter H, Chapter 801, Occupations Code, is |
---|
11 | 11 | | amended by adding Section 801.365 to read as follows: |

12 | 12 | | Sec. 801.365. BREEDING STOCK. (a) In this section, |
---|
13 | 13 | | "breeding stock" means a bovine animal intended by its owner or |
---|
14 | 14 | | caretaker, with the input of a veterinarian, to be used for |
---|
15 | 15 | | selective mating to maintain or enhance desirable genetic traits in |
---|
16 | 16 | | future generations and not intended, at the time a drug is |
---|
17 | 17 | | administered to the animal as provided by this section, for human or |
---|
18 | 18 | | animal consumption. The term does not include a market animal. |
---|
19 | 19 | | (b) A veterinarian may administer, prescribe, dispense, or |
---|
20 | 20 | | deliver any drug derived from a naturally occurring hormone in |
---|
21 | 21 | | breeding stock. The veterinarian shall determine and prescribe an |
---|
22 | 22 | | adequate withdrawal time for the drug. |
---|
23 | 23 | | (c) An owner or caretaker may use a drug described by |
---|
24 | 24 | | Subsection (b) in breeding stock in the manner prescribed by a |
---|
25 | 25 | | veterinarian. |
---|
26 | 26 | | SECTION 2. This Act takes effect immediately if it receives |
---|
27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
---|
28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
---|
30 | 30 | | Act takes effect September 1, 2021. |
