| 7 | 7 | | relating to the inclusion of temporary vehicle tags in the offense |

| 8 | 8 | | of tampering with a governmental record. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 37.01(2), Penal Code, is amended to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (2) "Governmental record" means: |
|---|
| 13 | 13 | | (A) anything belonging to, received by, or kept |
|---|
| 14 | 14 | | by government for information, including a court record; |
|---|
| 15 | 15 | | (B) anything required by law to be kept by others |
|---|
| 16 | 16 | | for information of government; |
|---|
| 17 | 17 | | (C) a license, certificate, permit, seal, title, |
|---|
| 18 | 18 | | letter of patent, or similar document issued by government, by |
|---|
| 19 | 19 | | another state, or by the United States; |
|---|
| 20 | 20 | | (D) a standard proof of motor vehicle liability |
|---|
| 21 | 21 | | insurance form described by Section 601.081, Transportation Code, a |
|---|
| 22 | 22 | | certificate of an insurance company described by Section 601.083 of |
|---|
| 23 | 23 | | that code, a document purporting to be such a form or certificate |
|---|
| 24 | 24 | | that is not issued by an insurer authorized to write motor vehicle |
|---|
| 25 | 25 | | liability insurance in this state, an electronic submission in a |
|---|
| 26 | 26 | | form described by Section 502.046(i), Transportation Code, or an |
|---|
| 27 | 27 | | evidence of financial responsibility described by Section 601.053 |
|---|
| 28 | 28 | | of that code; |
|---|
| 29 | 29 | | (E) an official ballot or other election record; |
|---|
| 30 | 30 | | [or] |
|---|
| 31 | 31 | | (F) the written documentation a mobile food unit |
|---|
| 32 | 32 | | is required to obtain under Section 437.0074, Health and Safety |
|---|
| 33 | 33 | | Code; or |
|---|
| 34 | 34 | | (G) a temporary tag issued under Chapter 502 or |
|---|
| 35 | 35 | | 503, Transportation Code. |
|---|
| 36 | 36 | | SECTION 2. Section 521.3466(a), Transportation Code, is |
|---|
| 37 | 37 | | amended to read as follows: |
|---|
| 38 | 38 | | (a) A license is automatically revoked on final conviction |
|---|
| 39 | 39 | | of the license holder of an offense under Section 37.10, Penal Code, |
|---|
| 40 | 40 | | if the governmental record was a motor vehicle license plate or |
|---|
| 41 | 41 | | registration insignia, within the meaning of Chapter 502, a |
|---|
| 42 | 42 | | temporary tag issued under Chapter 502 or 503, or a vehicle |
|---|
| 43 | 43 | | inspection report, within the meaning of Chapter 548. |
|---|
| 44 | 44 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 45 | 45 | | an offense committed on or after the effective date of this Act. An |
|---|
| 46 | 46 | | offense committed before the effective date of this Act is governed |
|---|
| 47 | 47 | | by the law in effect on the date the offense was committed, and the |
|---|
| 48 | 48 | | former law is continued in effect for that purpose. For purposes of |
|---|
| 49 | 49 | | this section, an offense was committed before the effective date of |
|---|
| 50 | 50 | | this Act if any element of the offense occurred before that date. |
|---|
| 51 | 51 | | SECTION 4. This Act takes effect September 1, 2021. |
