| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter A, Chapter 81, Property Code, is |
|---|
| 12 | 12 | | amended by adding Section 81.0031 to read as follows: |
|---|
| 13 | 13 | | Sec. 81.0031. REGISTRATION OF ASSOCIATION REQUIRED. (a) |
|---|
| 14 | 14 | | In this section, "condominium association" means a unit owner's |
|---|
| 15 | 15 | | association of a condominium regime. |
|---|
| 16 | 16 | | (b) A condominium association shall annually register with |
|---|
| 17 | 17 | | the secretary of state. |
|---|
| 18 | 18 | | (c) A registration must include the names and contact |
|---|
| 19 | 19 | | information of members of the governing body of the condominium |
|---|
| 20 | 20 | | association. |
|---|
| 21 | 21 | | (d) A condominium association may not collect association |
|---|
| 22 | 22 | | dues or fees unless the condominium association is registered with |
|---|
| 23 | 23 | | the secretary of state. |

| 24 | 24 | | SECTION 2. Subchapter A, Chapter 82, Property Code, is |

| 25 | 25 | | amended by adding Section 82.009 to read as follows: |

| 47 | 47 | | SECTION 4. The secretary of state shall adopt rules |

| 48 | 48 | | necessary to implement Sections 81.0031, 82.009, and 209.0031, |
|---|
| 49 | 49 | | Property Code, as added by this Act, not later than January 1, 2022. |
|---|
| 50 | 50 | | SECTION 5. (a) Except as provided by Subsection (b) of this |
|---|
| 51 | 51 | | section, this Act takes effect January 1, 2022. |
|---|
| 52 | 52 | | (b) Section 4 of this Act takes effect September 1, 2021. |
