10 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 13 | | SECTION 1. Subchapter H, Chapter 411, Government Code, is |
---|
12 | 14 | | amended by adding Section 411.1742 to read as follows: |
---|
13 | 15 | | Sec. 411.1742. VOLUNTARY CONTRIBUTION TO OPEN BURN PIT |
---|
14 | 16 | | REGISTRY FUND. (a) When a person applies for an original or renewal |
---|
15 | 17 | | license to carry a handgun under this subchapter, the person may |
---|
16 | 18 | | make a voluntary contribution in any amount to the open burn pit |
---|
17 | 19 | | registry fund established by Section 99.008, Health and Safety |
---|
18 | 20 | | Code. |
---|
19 | 21 | | (b) The department shall: |
---|
20 | 22 | | (1) include space on the first page of each |
---|
21 | 23 | | application for an original or renewal license to carry a handgun |
---|
22 | 24 | | that allows a person applying for an original or renewal license to |
---|
23 | 25 | | carry a handgun to indicate the amount that the person is |
---|
24 | 26 | | voluntarily contributing to the fund; and |
---|
25 | 27 | | (2) provide an opportunity for the person to |
---|
26 | 28 | | contribute to the fund during the application process for an |
---|
27 | 29 | | original or renewal license to carry a handgun on the department's |
---|
28 | 30 | | Internet website. |
---|
29 | 31 | | (c) The department shall send any contribution made under |
---|
30 | 32 | | this section to the comptroller for deposit in the state treasury to |
---|
31 | 33 | | the credit of the open burn pit registry fund not later than the |
---|
32 | 34 | | 14th day of each month. Before sending the money to the fund, the |
---|
33 | 35 | | department may deduct money equal to the amount of reasonable |
---|
34 | 36 | | expenses for administering this section. |
---|
35 | 37 | | SECTION 2. Chapter 99, Health and Safety Code, as added by |
---|
36 | 38 | | Chapter 153 (H.B. 306), Acts of the 86th Legislature, Regular |
---|
37 | 39 | | Session, 2019, is amended by adding Section 99.008 to read as |
---|
38 | 40 | | follows: |
---|
39 | 41 | | Sec. 99.008. OPEN BURN PIT REGISTRY FUND. (a) The open burn |
---|
40 | 42 | | pit registry fund is a special fund in the state treasury outside |
---|
41 | 43 | | the general revenue fund. The fund is composed of: |
---|
42 | 44 | | (1) money transferred to the fund at the direction of |
---|
43 | 45 | | the legislature; |
---|
44 | 46 | | (2) gifts and grants contributed to the fund; |
---|
45 | 47 | | (3) the earnings of the fund; and |
---|
46 | 48 | | (4) money deposited to the credit of the fund under |
---|
47 | 49 | | Section 411.1742, Government Code. |
---|
48 | 50 | | (b) Money in the fund may be appropriated only to the |
---|
49 | 51 | | department. The department may use the money only for the creation |
---|
50 | 52 | | and maintenance of the open burn pit registry established under |
---|
51 | 53 | | Section 99.003, except that the department may use the money for any |
---|
52 | 54 | | other purpose of the department consistent with legislative |
---|
53 | 55 | | appropriation of the money if the department finds that the |
---|
54 | 56 | | registry is adequately funded and contributions to the fund exceed |
---|
55 | 57 | | the amount necessary for the registry to be adequately funded. |
---|
56 | 58 | | SECTION 3. As soon as practicable after the effective date |
---|
57 | 59 | | of this Act, the Department of Public Safety shall modify the |
---|
58 | 60 | | application form for a license to carry a handgun to satisfy the |
---|
59 | 61 | | requirement of Section 411.1742, Government Code, as added by this |
---|
60 | 62 | | Act. |
---|
61 | 63 | | SECTION 4. This Act takes effect September 1, 2021. |
