The bill would amend Subchapter A, Chapter 2165, Government Code, to authorize a state agency in charge and control of state property, including a state park or rest area, to enter into an agreement authorizing a charging provider who provides to another person the use of electric vehicle charging equipment in a commercial transaction to place and maintain electric vehicle charging equipment on the property.Based on the information and analysis provided by the Texas Department of Transportation (TxDOT), Texas Facilities Commission (TFC), and the Texas Parks and Wildlife Department (TPWD), it is assumed any costs or duties associated with entering into an agreement authorized by the bill could be absorbed within existing resources. According to TFC, a state agency could be responsible for some costs of accommodating an electric vehicle charging facility on state property depending on the terms of the agreement. TxDOT indicates that the department may choose to enter into a lease agreement for the vendor's use of TxDOT right-of-way at a fair market rate or may waive a lease fee under certain circumstances. Because the number and terms of agreements that may be executed under the provisions of the bill are unknown, the potential impact to state operating costs and revenue cannot be determined at this time. Based on the information provided by TFC and TxDOT, it is assumed implementation of the provisions of the bill would not result in a significant fiscal impact to the State.
