911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Subchapter A, Chapter 2165, Government Code, is
1113 amended by adding Section 2165.010 to read as follows:
1214 Sec. 2165.010. PLACEMENT OF ELECTRIC VEHICLE CHARGING
13- EQUIPMENT IN STATE PARK. (a) In this section:
15+ EQUIPMENT ON STATE PROPERTY. (a) In this section:
1416 (1) "Charging provider" means a person who provides to
1517 another person the use of electric vehicle charging equipment in a
1618 commercial transaction.
1719 (2) "Electric vehicle charging equipment" means
1820 equipment manufactured for transferring electric energy from
1921 electric supply to an electric vehicle.
2022 (3) "Metering device" means a commercial device used
2123 to measure electric energy transferred by electric vehicle charging
2224 equipment and compute the charge for the transferred energy.
23- (b) A state agency in charge and control of a state park may
24- enter into an agreement authorizing a charging provider to place
25- and maintain electric vehicle charging equipment in the park.
25+ (b) A state agency in charge and control of state property,
26+ including a state park, may enter into an agreement authorizing a
27+ charging provider to place and maintain electric vehicle charging
28+ equipment on the property.
2629 (c) An agreement described by Subsection (b):
2730 (1) must require the charging provider to use a
2831 metering device to determine the cost of electricity transferred to
2932 another person through electric vehicle charging equipment; and
3033 (2) may include any other reasonable requirements on
31- the use of the state park property.
32- (d) An agreement executed by the Parks and Wildlife
33- Department with another person under this section must contain a
34- provision requiring any cost associated with placing and
35- maintaining electric vehicle charging equipment, including costs
36- incurred for electricity, to be paid by the other person.
