79 relating to the authorized activities of a manufacturer's agent's
810 warehousing permit holder.
911 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1012 SECTION 1. Section 55.01(a), Alcoholic Beverage Code, as
1113 effective September 1, 2021, is amended to read as follows:
1214 (a) The holder of a manufacturer's agent's warehousing
1315 permit may:
1416 (1) receive malt beverages from one license holder
1517 that is authorized to sell the malt beverages to licensed
1618 distributors in this state [the holder of a nonresident brewer's
1719 license] and store the alcoholic beverages on the permitted
1820 premises;
1921 (2) ship, cause to be shipped, sell, and otherwise
2022 transfer the malt beverages to licensed distributors in this state
2123 who are authorized to receive the malt beverages and to persons
2224 outside this state who are qualified to receive the malt beverages
2325 under the regulatory laws of the state or other jurisdiction in
2426 which the malt beverages are received; [and]
2527 (3) return malt beverages to the license holder
2628 [brewer] from which they were originally received; and
2729 (4) unpack, repack, or co-pack malt beverages of the
2830 same brand in any combination or configuration as permissible for
2931 the license holder for whom the permittee is an agent.
3032 SECTION 2. This Act takes effect September 1, 2021.
