| 9 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 12 | | SECTION 1. Section 55.01(a), Alcoholic Beverage Code, as |
|---|
| 11 | 13 | | effective September 1, 2021, is amended to read as follows: |
|---|
| 12 | 14 | | (a) The holder of a manufacturer's agent's warehousing |
|---|
| 13 | 15 | | permit may: |
|---|
| 14 | 16 | | (1) receive malt beverages from one license holder |
|---|
| 15 | 17 | | that is authorized to sell the malt beverages to licensed |
|---|
| 16 | 18 | | distributors in this state [the holder of a nonresident brewer's |
|---|
| 17 | 19 | | license] and store the alcoholic beverages on the permitted |
|---|
| 18 | 20 | | premises; |
|---|
| 19 | 21 | | (2) ship, cause to be shipped, sell, and otherwise |
|---|
| 20 | 22 | | transfer the malt beverages to licensed distributors in this state |
|---|
| 21 | 23 | | who are authorized to receive the malt beverages and to persons |
|---|
| 22 | 24 | | outside this state who are qualified to receive the malt beverages |
|---|
| 23 | 25 | | under the regulatory laws of the state or other jurisdiction in |
|---|
| 24 | 26 | | which the malt beverages are received; [and] |
|---|
| 25 | 27 | | (3) return malt beverages to the license holder |
|---|
| 26 | 28 | | [brewer] from which they were originally received; and |
|---|
| 27 | 29 | | (4) unpack, repack, or co-pack malt beverages of the |
|---|
| 28 | 30 | | same brand in any combination or configuration as permissible for |
|---|
| 29 | 31 | | the license holder for whom the permittee is an agent. |
|---|
| 30 | 32 | | SECTION 2. This Act takes effect September 1, 2021. |
