66 relating to a municipality collecting a delinquent fine or fee.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subtitle A, Title 4, Local Government Code, is
99 amended by adding Chapter 109 to read as follows:
1010 CHAPTER 109. BAR ON COLLECTION
1111 Sec. 109.001. BAR ON COLLECTION OF DELINQUENT FINE OR FEE.
1212 (a) A municipality may not collect a fine or fee from a person that
1313 has been delinquent for more than five years unless the
1414 municipality has made a reasonable attempts to provided notice to
1515 the person under Subsection (b).
1616 (b) A municipality must provide notice under Subsection (a)
1717 by certified mail to the person's last known address. If the
1818 municipality does not have a record of the person's address, the
1919 municipality must provide notice by any other means available to
2020 the municipality.
2121 SECTION 2. Section 109.001, Local Government Code, as added
2222 by this Act, applies only to a fine or fee assessed by a
2323 municipality on or after the effective date of this Act. A fine or
2424 fee assessed before the effective date of this Act is governed by
2525 the law in effect on the date the fine or fee was assessed, and the
2626 former law is continued in effect for that purpose.
2727 SECTION 3. This Act takes effect September 1, 2021.
