7 | 7 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
8 | 8 | SECTION 1. Subtitle A, Title 4, Local Government Code, is | |
9 | 9 | amended by adding Chapter 109 to read as follows: | |
10 | 10 | CHAPTER 109. BAR ON COLLECTION | |
11 | 11 | Sec. 109.001. BAR ON COLLECTION OF DELINQUENT FINE OR FEE. | |
12 | 12 | (a) A municipality may not collect a fine or fee from a person that | |
13 | 13 | has been delinquent for more than five years unless the | |
14 | 14 | municipality has made a reasonable attempts to provided notice to | |
15 | 15 | the person under Subsection (b). | |
16 | 16 | (b) A municipality must provide notice under Subsection (a) | |
17 | 17 | by certified mail to the person's last known address. If the | |
18 | 18 | municipality does not have a record of the person's address, the | |
19 | 19 | municipality must provide notice by any other means available to | |
20 | 20 | the municipality. | |
21 | 21 | SECTION 2. Section 109.001, Local Government Code, as added | |
22 | 22 | by this Act, applies only to a fine or fee assessed by a | |
23 | 23 | municipality on or after the effective date of this Act. A fine or | |
24 | 24 | fee assessed before the effective date of this Act is governed by | |
25 | 25 | the law in effect on the date the fine or fee was assessed, and the | |
26 | 26 | former law is continued in effect for that purpose. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2021. |
