66 relating to the report of right-angle collisions of vehicles.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter E, Chapter 550, Transportation Code,
99 is amended by adding Section 550.082 to read as follows:
1010 Sec. 550.082. Report of Right-Angle Collision; Traffic
1111 Study. (a) This section applies only to an intersection of
1212 roadways at least one of which is part of the state highway system
1313 or of a roadway that is part of the state highway system with an
1414 alley or driveway and only if the intersection is not controlled by
1515 a traffic-control signal.
1616 (b) A law enforcement officer who investigates a
1717 right-angle collision at an intersection shall file a written
1818 report stating the occurrence and location of the collision with:
1919 (1) the Texas Department of Transportation; and
2020 (2) if the collision occurred in a municipality, the
2121 municipal police department of the municipality.
2222 (c) If during any 12-month period a governmental entity
2323 receives under this section 10 or more reports of right-angle
2424 collisions that occur at the same intersection, the governmental
2525 entity shall perform a traffic study of that location and shall take
2626 the actions that the governmental entity determines reasonable and
2727 necessary to improve the safety at the location.
2828 (d) The information collected under this section is
2929 privileged from discovery, is confidential for purposes of Chapter
3030 552, Government Code, and is not admissible in a court on any issue
3131 of liability. This section does not waive sovereign immunity and
3232 has no effect on any of the exclusions and exceptions contained in
3333 Chapter 101, Civil Practices and Remedies Code
3434 (e) In this section:
3535 (1) "Right-angle collision" means a motor vehicle
3636 collision in which the side of one vehicle is struck by the front or
3737 rear of another vehicle.
3838 (2) "Roadway" means a street, road, or highway.
3939 SECTION 2. This Act takes effect September 1, 2021.
