| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subchapter E, Chapter 550, Transportation Code, |
|---|
| 9 | 9 | | is amended by adding Section 550.082 to read as follows: |
|---|
| 10 | 10 | | Sec. 550.082. Report of Right-Angle Collision; Traffic |
|---|
| 11 | 11 | | Study. (a) This section applies only to an intersection of |
|---|
| 12 | 12 | | roadways at least one of which is part of the state highway system |
|---|
| 13 | 13 | | or of a roadway that is part of the state highway system with an |
|---|
| 14 | 14 | | alley or driveway and only if the intersection is not controlled by |
|---|
| 15 | 15 | | a traffic-control signal. |
|---|
| 16 | 16 | | (b) A law enforcement officer who investigates a |
|---|
| 17 | 17 | | right-angle collision at an intersection shall file a written |
|---|
| 18 | 18 | | report stating the occurrence and location of the collision with: |
|---|
| 19 | 19 | | (1) the Texas Department of Transportation; and |
|---|
| 20 | 20 | | (2) if the collision occurred in a municipality, the |
|---|
| 21 | 21 | | municipal police department of the municipality. |
|---|
| 22 | 22 | | (c) If during any 12-month period a governmental entity |
|---|
| 23 | 23 | | receives under this section 10 or more reports of right-angle |
|---|
| 24 | 24 | | collisions that occur at the same intersection, the governmental |
|---|
| 25 | 25 | | entity shall perform a traffic study of that location and shall take |
|---|
| 26 | 26 | | the actions that the governmental entity determines reasonable and |
|---|
| 27 | 27 | | necessary to improve the safety at the location. |
|---|
| 28 | 28 | | (d) The information collected under this section is |
|---|
| 29 | 29 | | privileged from discovery, is confidential for purposes of Chapter |
|---|
| 30 | 30 | | 552, Government Code, and is not admissible in a court on any issue |
|---|
| 31 | 31 | | of liability. This section does not waive sovereign immunity and |
|---|
| 32 | 32 | | has no effect on any of the exclusions and exceptions contained in |
|---|
| 33 | 33 | | Chapter 101, Civil Practices and Remedies Code |
|---|
| 34 | 34 | | (e) In this section: |
|---|
| 35 | 35 | | (1) "Right-angle collision" means a motor vehicle |
|---|
| 36 | 36 | | collision in which the side of one vehicle is struck by the front or |
|---|
| 37 | 37 | | rear of another vehicle. |
|---|
| 38 | 38 | | (2) "Roadway" means a street, road, or highway. |
|---|
| 39 | 39 | | SECTION 2. This Act takes effect September 1, 2021. |
