| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter H, Chapter 49, Water Code, is amended | |
| 11 | 11 | by adding Section 49.2127 to read as follows: | |
| 12 | 12 | Sec. 49.2127. PIPELINE FEES AND REQUIREMENTS IMPOSED BY | |
| 13 | 13 | CERTAIN DISTRICTS. (a) In this section, "retail public utility" | |
| 14 | 14 | has the meaning assigned by Section 13.002. | |
| 15 | 15 | (b) This section applies only to a district whose territory | |
| 16 | 16 | is located wholly or partly in a county: | |
| 17 | 17 | (1) located on the Gulf of Mexico and an international | |
| 18 | 18 | border; or | |
| 19 | 19 | (2) adjacent to a county described by Subdivision (1). | |
| 20 | 20 | (c) Notwithstanding Section 49.002, this section prevails | |
| 21 | 21 | over a special law governing a district. | |
| 22 | 22 | (d) A district may not impose on a retail public utility | |
| 23 | 23 | that proposes to construct a water or sewer pipeline or associated | |
| 24 | 24 | infrastructure in the district's service area: | |
| 25 | 25 | (1) requirements for constructing the pipeline that | |
| 26 | 26 | are unduly burdensome; or | |
| 27 | 27 | (2) a fee or deposit that is greater than: | |
| 28 | 28 | (A) the actual and reasonable costs to review and | |
| 29 | 29 | approve the proposed construction; or | |
| 30 | 30 | (B) $200. | |
| 31 | 31 | SECTION 2. This Act takes effect September 1, 2021. |
