105 AN ACT
116 relating to operating agreements between holders of a distiller's
127 and rectifier's permit and certain alcoholic beverage permit
138 holders.
149 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1510 SECTION 1. Chapter 14, Alcoholic Beverage Code, is amended
1611 by adding Section 14.10 to read as follows:
1712 Sec. 14.10. OPERATING AGREEMENTS BETWEEN PERMIT HOLDERS.
1813 (a) The holder of a distiller's and rectifier's permit may enter
1914 into an agreement with another holder of a distiller's and
2015 rectifier's permit that allows the distiller's and rectifier's
2116 permit holder to engage in the following activities on the
2217 permitted premises of the other distiller's and rectifier's permit
2318 holder:
2419 (1) manufacture distilled spirits;
2520 (2) rectify, purify, and refine distilled spirits and
2621 wines;
2722 (3) mix wines, distilled spirits, or other liquors;
2823 (4) bottle, label, and package the permit holder's
2924 finished products;
3025 (5) sell the finished products in this state to
3126 holders of wholesaler's permits and to authorized wholesalers and
3227 manufacturers outside the state;
3328 (6) purchase distilled spirits, to be used only for
3429 manufacturing or rectification purposes, from holders of
3530 nonresident seller's permits or distiller's and rectifier's
3631 permits; and
3732 (7) sell bulk alcohol produced by the permit holder
3833 for purposes described by Section 38.01.
3934 (b) The agreement is subject to approval by the commission
4035 and must describe with specificity the nature, duration, and extent
4136 of the activities authorized by the agreement.
4237 (c) The holder of a distiller's and rectifier's permit may
4338 enter into an agreement authorized by Section 37.011 with the
4439 holder of a nonresident seller's permit.
4540 (d) The commission shall adopt rules regulating the shared
4641 use of the permitted premises under this section to ensure
4742 administrative accountability of each permit holder and a strict
4843 separation between the businesses and operations of the permit
4944 holders.
5045 SECTION 2. Chapter 37, Alcoholic Beverage Code, is amended
5146 by adding Section 37.011 to read as follows:
5247 Sec. 37.011. OPERATING AGREEMENT WITH IN-STATE DISTILLERY.
5348 (a) The holder of a nonresident seller's permit who owns a
5449 distillery outside of the state may enter into an agreement with the
5550 holder of a distiller's and rectifier's permit that allows the
5651 nonresident seller to engage in the following activities on the
5752 distiller's and rectifier's permitted premises:
5853 (1) manufacture distilled spirits;
5954 (2) rectify, purify, and refine distilled spirits and
6055 wines;
6156 (3) mix wines, distilled spirits, or other liquors;
6257 (4) bottle, label, and package the nonresident
6358 seller's finished products; and
6459 (5) sell the finished products in this state to
6560 holders of distiller's and rectifier's permits and holders of
6661 wholesaler's permits and to authorized wholesalers and
6762 manufacturers outside the state.
6863 (b) The agreement is subject to approval by the commission
6964 and must describe with specificity the nature, duration, and extent
7065 of the activities authorized by the agreement.
7166 (c) The commission shall adopt rules regulating the shared
7267 use of the permitted premises under this section to ensure
7368 administrative accountability of each permit holder and a strict
7469 separation between the businesses and operations of the permit
7570 holders.
7671 SECTION 3. This Act takes effect September 1, 2021.
