66 AN ACT
77 relating to legislative oversight of investment in state agency
88 information technology improvement and modernization projects.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Q, Chapter 2054, Government Code, is
1111 amended by adding Section 2054.577 to read as follows:
1212 Sec. 2054.577. JOINT OVERSIGHT COMMITTEE ON INVESTMENT IN
1313 INFORMATION TECHNOLOGY IMPROVEMENT AND MODERNIZATION PROJECTS.
1414 (a) In this section, "committee" means the Joint Oversight
1515 Committee on Investment in Information Technology Improvement and
1616 Modernization Projects.
1717 (b) The committee is created to review investment and
1818 funding strategies for projects to improve or modernize state
1919 agency information technology systems.
2020 (c) The committee is composed of six members as follows:
2121 (1) three members of the senate appointed by the
2222 lieutenant governor; and
2323 (2) three members of the house of representatives
2424 appointed by the speaker of the house of representatives.
2525 (d) The presiding officer of the committee shall alternate
2626 annually between:
2727 (1) a member of the senate appointed by the lieutenant
2828 governor; and
2929 (2) a member of the house of representatives appointed
3030 by the speaker of the house of representatives.
3131 (e) A vacancy on the committee shall be filled in the same
3232 manner as the original appointment.
3333 (f) The committee biennially shall provide a written report
3434 to the legislature that:
3535 (1) identifies:
3636 (A) existing and planned projects to improve or
3737 modernize state agency information technology systems; and
3838 (B) the method of funding for each project
3939 identified by the committee under Paragraph (A); and
4040 (2) includes:
4141 (A) a determination by the committee of the
4242 amount necessary to fully fund each project identified under
4343 Subdivision (1) to completion; and
4444 (B) strategies developed by the committee to
4545 ensure a long-term investment solution for projects to improve or
4646 modernize state agency information technology systems is in place,
4747 including strategies to:
4848 (i) access the full amount of federal money
4949 available for those projects; and
5050 (ii) use information gathered by the
5151 department during previous projects to improve the management,
5252 oversight, and transparency of future projects.
5353 (g) The department shall provide staff support for the
5454 committee.
5555 (h) The committee:
5656 (1) has the powers of a joint committee; and
5757 (2) may obtain funding in the same manner as a joint
5858 committee.
5959 (i) The rules adopted by the 87th Legislature for the
6060 administration of joint committees apply to the committee to the
6161 extent the rules are consistent with this section.
6262 (j) The committee is abolished and this section expires
6363 September 1, 2026.
6464 SECTION 2. (a) In this section, "committee" means the Joint
6565 Oversight Committee on Investment in Information Technology
6666 Improvement and Modernization Projects.
6767 (b) The lieutenant governor and the speaker of the house of
6868 representatives shall make appointments to the committee not later
6969 than the 30th day after the effective date of this Act.
7070 (c) The speaker of the house of representatives shall
7171 appoint the initial presiding officer of the committee.
7272 SECTION 3. This Act takes effect immediately if it receives
7373 a vote of two-thirds of all the members elected to each house, as
7474 provided by Section 39, Article III, Texas Constitution. If this
7575 Act does not receive the vote necessary for immediate effect, this
7676 Act takes effect September 1, 2021.
