55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to Medicaid reimbursement rates.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 32.028, Human Resources Code, is amended
1010 by adding Subsection (o) to read as follows:
1111 (o) Notwithstanding any other provision of this section or
1212 other law, the executive commissioner shall ensure that the rules
1313 governing the determination of rates paid to a medical assistance
1414 provider are at least equal to the rates paid under Medicare for the
1515 provision of the same or substantially similar services.
1616 SECTION 2. Section 533.005, Government Code, is amended by
1717 adding Subsection (f) to read as follows:
1818 (f) In addition to the requirements specified by Subsection
1919 (a) and notwithstanding any other law, a contract described by that
2020 subsection must require the managed care organization to reimburse
2121 a provider who is in the organization's provider network and who
2222 provides health care services to a recipient at a rate that is at
2323 least equal to the rate paid under Medicare for the provision of the
2424 same or substantially similar service.
2525 SECTION 3. (a) The Health and Human Services Commission
2626 shall, in a contract between the commission and a managed care
2727 organization under Chapter 533, Government Code, that is entered
2828 into or renewed on or after the effective date of this Act, require
2929 that the managed care organization comply with Section 533.005(f),
3030 Government Code, as added by this Act.
3131 (b) The Health and Human Services Commission shall seek to
3232 amend contracts entered into with managed care organizations under
3333 Chapter 533, Government Code, before the effective date of this Act
3434 to require those managed care organizations to comply with Section
3535 533.005(f), Government Code, as added by this Act. To the extent of
3636 a conflict between Section 533.005(f), Government Code, as added by
3737 this Act, and a provision of a contract with a managed care
3838 organization entered into before the effective date of this Act,
3939 the contract provision prevails.
4040 SECTION 4. If before implementing any provision of this Act
4141 a state agency determines that a waiver or authorization from a
4242 federal agency is necessary for implementation of that provision,
4343 the agency affected by the provision shall request the waiver or
4444 authorization and may delay implementing that provision until the
4545 waiver or authorization is granted.
4646 SECTION 5. This Act takes effect September 1, 2021.
