| 6 | 12 | | or physician assistant regarding death certificates. |

| 7 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 14 | | SECTION 1. Section 193.005(a), Health and Safety Code, is |
|---|
| 9 | 15 | | amended to read as follows: |
|---|
| 10 | 16 | | (a) A person required to file a death certificate or fetal |
|---|
| 11 | 17 | | death certificate shall obtain the required medical certification |
|---|
| 12 | 18 | | from the decedent's attending physician, or[, subject to Subsection |
|---|
| 13 | 19 | | (a-1),] a physician assistant or advanced practice registered nurse |
|---|
| 14 | 20 | | of the decedent, if the death occurred under the care of the person |
|---|
| 15 | 21 | | in connection with the treatment of the condition or disease |
|---|
| 16 | 22 | | process that contributed to the death. |
|---|
| 17 | 23 | | SECTION 2. Section 193.005(a-1), Health and Safety Code, is |
|---|
| 18 | 24 | | repealed. |
|---|
| 19 | 25 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 20 | 26 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 27 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 28 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 29 | | Act takes effect September 1, 2021. |
