66 AN ACT
77 relating to the expansion of eligibility for Medicaid to certain
88 persons diagnosed with certain mental health disorders for whom
99 federal matching money is available.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1212 is amended by adding Section 32.02473 to read as follows:
1313 Sec. 32.02473. EXPANDED ELIGIBILITY FOR MEDICAL
1414 ASSISTANCE. (a) Notwithstanding any other law, the commission
1515 shall provide medical assistance to all persons:
1616 (1) who are diagnosed with bipolar disorder,
1717 dysthymia, schizophrenia, or severe chronic depression;
1818 (2) who have a family income that does not exceed 133
1919 percent of the applicable federal poverty level;
2020 (3) who apply for the assistance; and
2121 (4) for whom federal matching money is available.
2222 (b) The executive commissioner shall adopt rules necessary
2323 to implement this section.
2424 SECTION 2. Section 32.02473, Human Resources Code, as added
2525 by this Act, applies only to an initial determination or
2626 recertification of eligibility of a person for medical assistance
2727 under Chapter 32, Human Resources Code, made on or after the date
2828 the section is implemented, regardless of the date the person
2929 applied for that assistance.
3030 SECTION 3. As soon as possible after the effective date of
3131 this Act, the executive commissioner of the Health and Human
3232 Services Commission shall take all necessary actions to expand
3333 eligibility for medical assistance under Chapter 32, Human
3434 Resources Code, in accordance with Section 32.02473, Human
3535 Resources Code, as added by this Act, including notifying
3636 appropriate federal agencies of that expanded eligibility.
3737 SECTION 4. If before implementing any provision of this Act
3838 a state agency determines that any other waiver or authorization
3939 from a federal agency is necessary for implementation of that
4040 provision, the agency affected by the provision shall request the
4141 waiver or authorization and may delay implementing that provision
4242 until the waiver or authorization is granted.
4343 SECTION 5. This Act takes effect September 1, 2021.
